This Act provides generally for registration of rights in land and land tenure in Belize. “Land” includes land covered with water, all things growing on land and buildings and other things permanently affixed to land. Except as otherwise provided in this Act, but subject to section 38 of National Lands Act, no law, practice or procedure relating to land shall apply to land registered under this Act so far as it is inconsistent with this Act.
This Act makes provision for the administration of estates in Belize of deceased foreign persons. It assigns powers to representatives of specified countries of origin of the deceased person to administer the estate if there is no person present in Belize at the time of death who is rightfully entitled to administer the estate of such deceased person. Nothing contained in this Act shall affect the Crown’s right under the Administration of Estates Act. The representative shall apply for letters of administration to be issued by court.
This Act makes provision for the administration of (intestate) estates by persons appointed as administrators under this Act or by (probate of) will and also concerns other related matters of inheritance. Real estate (including lease) of a person dying intestate shall devolve in the manner provided by section 4, and the residuary estate of that person shall be distributed in accordance with section 54.
This Act makes provision with respect to the protection and conservation of ancient monuments and related matters such as the acquisition of land by the Government for purposes of this Act. All ancient monuments and antiquities, whether upon any land or in any river, stream or watercourse, or under territorial waters of the country, shall vest in the Government and no person shall possess or have in custody any ancient monument or antiquity except under a licence granted by the Minister in the prescribed form.
This Act concerns proceedings of the Supreme Court of Judicature to ascertain the boundaries of land held under any title or of any national land in case that there is any doubt as to the extent, identity, or boundaries of such land. Proceedings under this Act may be commenced or defended by any person (except those as specified in this Act) interested in any land which is or may be affected by the proceedings. Where national land is or may be so affected, whether directly or indirectly, proceedings may be taken by or against the Crown in accordance with the Crown Proceedings Act.
The Act provides for acquisition of private land by the Crown and related procedures.The Act consists of 36 sections divided into 8 Parts: Preliminary (I); Compulsory Acquisition of land and Abandonment of Acquisition (II); Appointment and Powers of Board of Assessment (III); Determination of Small Claims for Compensation (IV); Provisions Governing Assessment of Compensation, etc.
This Act shall apply to every tenancy as defined in section 3 of the Landlord and Tenant Act in respect to any land, other than national land or land within a town, and is created under a contract that: (a) is not in writing; or (b) does not provide for a term certain of more than two years; or (c) does provide for a term certain of more than two years and contains a provision whereby either the landlord or the tenant may terminate the tenancy by less than six months’ notice for any reason other than that of non-observance or of non-compliance with any of the provisions of the contract of t
There shall be appointed a Commissioner of Lands and Surveys who shall, subject to this Act: (a) direct, supervise and control all public surveys; (b) ensure that all surveys and plans are effected in accordance with the laws of Belize. The Commissioner may by notice published in the Gazette delegate any of his or her functions under this Act to any officer of the Lands and Surveys. The Land Surveyors Board is established under section 4. The Board shall issue licences to practice land surveying in accordance with this Act. The Board shall keep a register of licensed surveyors.
Section 3 defines kinds of land holding tenancies, i.e., tenancy for years, a tenancy from year to year, a tenancy for less than a year, a tenancy at will and a tenancy on sufferance. The tenancies defined in section 3 comprise the relationships between landlord and tenant in Belize and, subject to this Act, have the same qualities and incidents as they would have under the common law of England.
The Act makes provision for prescription in respect of claims relative to water or land pursuant to common law by custom, prescription or grant.
