    This Act amends the Barbuda Land Act in section 2 (concerning the definition of "major development"), in section 6 (concerning the lease of land for major development, in section 8 (concerning the conversion of rights into leases and in section 11 (concerning administration and development of land.

    The carrying out provisions of this Ordinance shall be vested in the Central Housing and Planning Authority (sect. 3). The Authority may make Regulation regarding procedures for the adoption of planning schemes and may by resolution decide to prepare, adopt, or vary a scheme. Those schemes shall be submitted to the Administrator in Council for approval under section 6. "Schemes" includes a town planning scheme, a regional scheme, a supplementary scheme and a scheme varying or revoking an existing scheme (sect. 2).

    The Act consists of 83 sections divided into 10 Parts: Preliminary (I); Administration (II); Development plans (III); Control of development of land (IV); Enforcement (V); Environmental protection (VI); Building regulations (VII); Compensation and acquisition (VIII); Appeals (IX); Miscellaneous and supplementary (X).Section 3 defines duties of the Minister and particular holds the Minister responsible for securing the objects and purposes set out in section 3. A Development Control Authority is established as a body corporate under section 5.

    This Act makes provision for rights in land of the Crown and citizens of Barbuda and related matters such as registration and provides rules relative to the development of land in Barbuda.The Act states that all land shall be owned in common by the people of Barbuda and that the land shall vest in the Crown on behalf of the people of Barbuda. No land in Barbuda shall be sold and no person shall acquire the ownership of any land. The Council of Barbuda may grant leases of land for major developments.

    This Act provides for the control on the development of land and for this purpose establishes the Development Control Authority. "It shall be the duty of the Authority to institute a survey of the State, examining the matters which may be expected to affect the development of the State or the planning of its development and in any event to keep all such matters under review" (sect. 6(1)). For the purposes of subsection (1), the Authority shall prepare a survey of matters mentioned in subsection (1) and a Development Plan as described in subsection (3) of section 6.

    This Act makes provision for the payment of compensation for withholding of property by persons acting in collusion with tenants and for the recovery of non-paid rent. The Act also makes provision for the renewal of leases without the surrender of land.

    This Act amends the Registered Land Act with respect to a wide variety of matters including: general powers of the Registrar, registration of land and land registers, execution of instruments and other legal acts that may bring about a change in legal status of a real property. Some provisions concern lost or missing information in registers, evidence of legal status of a property for purposes of registration by the Registrar and registration of properties in the name of private owners of lands that were vested in the Crown by default during the cadastral survey.

    This Act concerns: (a) the imposition of taxes on land including improvements and all estates, interests, easements and rights pertaining to land; and (b) the valuation of real property for purposes of taxation.The Act assigns the function of administration of provisions of this Act to the Commissioner of Inland Revenue and provides for the appointment of a Chief Valuation Officer and Valuation Officers. For purposes of this Act, property shall be classified as: "agricultural”, ”residential” or “other property”.
