The Governor shall appoint a Commission to deal with concessions confirmed by the Chief Court. Any concession or grant on land conferring any of the rights listed in article 4 shall be suspended until further notification is made according to the provisions of this Act.
The Act determines in the Schedule the areas set apart under section 2 of the Concessions Partition Act, and states the conditions under which the Swazi nation is entitled to the sole and exclusive use and occupation of said areas.
This Act, among other things, recognizes the Minerals Management Board as established by section 214 of the Constitution and provides rules relative to exploration and exploitation of minerals in Swaziland. The Act defines functions and powers of the Board, establishes an office of the Commissioner of Mines and defines functions of the Commissioner of Mines. A distinction is made between small-scale and large-scale operations for the purposes of this Act.

The Act contains a list of certain areas to be proclaimed as Crown lands. The Proclamation of said areas as Crown lands shall not affect any concession, lease, servitude or other right existing in respect of the said areas at the date set out in the third column of the Schedule to this Act and not vested in the Crown.
The Minister may dispose of Crown lands by grant, sale, lease or otherwise in such manner and on such conditions as he may deem advisable, and may grant any Crown land in exchange for any other land or interest therein. All rights to precious or base metals, precious stones, minerals or mineral products shall be excluded from the grant, sale, lease or other disposal of Crown lands.
The Act establishes the procedure for the acquisition of any real property needed for public purposes, and, in the case of immovable property, for the acquisition by freehold title or by leasehold. The procedure includes, inter alia, preliminary investigations, notice of intention to take property to the persons concerned, power to take possession.
The Special Commissioner appointed to exercise the duties imposed by this Act, shall set apart portions of land affected by any land concession or land concessions for the sole and exclusive use and occupation by Swazis, and shall for such purpose order the survey and demarcation of land. Further provisions concern the issue of freehold title in favour of concessionaires having (a) title to the ownership of land; or (b) a lease of land which is not less than ninety-year's duration under the conditions established in section 6 of the Regulation.
The Act establishes inter alia (a) the criteria to be taken into account in ascertaining the value of the property for the payment of transfer duty; (b) a list of costs and charges that do not form part of the valuation on which the duty is payable; (c) the deadline for the payment of the duty in case of sale, lease, exchange or donation, deferred possession, conditional sale, lease, exchange or donation, joint ownership. Exemptions from the transfer duty shall be allowed in the cases and to the extent provided for in Section 13.
