Documentos de política y resúmenesJunio, 2006KenyaThe illegal and irregular allocations of public land as chronicled in the Ndungu Report amount to a rip-off that dwarfs the Goldenberg and Anglo-Leasing scandals. Our analysis in this first issue in the series covers Karura, Ngong Road and Kiptagich forests and suggests a loss of public resources in excess of Ksh.18.4 billion. The Ndungu Report covers ten other forests as well as other public land, ranging from road reserves to cemeteries to public toilets and even State House land. As we cover these in future issues of the series, the cumulative loss will certainly be astounding.

Popularly known as the ‘Ndung’u’ Report, the publication of this three-volume document is important to the Kenya Land Alliance for two major reasons. Firstly, the appointment of the Coordinator of the Kenya Land Alliance to the Commission marked a threshold in the relations between KLA and the Government of Kenya.

This Act provides rules for the prospecting for and mining of minerals specified in the First Schedule to this Act. Save to the extent provided for in this Act, it shall not apply to matters relating to petroleum and hydrocarbon gases. The Cabinet Secretary responsible for mining, the Principal Secretary of the responsible ministry and any person shall be guided by the values and principles enshrined in the Constitution and in particular Articles 10, 66 (2), 201 (c) and (d), and 232 of the Constitution and the principles of leadership and integrity.

These Regulations of the National Land Commission, made under section 36 of the National Land Commission Act, 2012, concern correction of historical land injustices that occurred in a period between 1895 and 2010. Pursuant to Article 67 (2) (e) of the Constitution and section 15 (1) of the National Land Commission Act, 2012, the Commission may initiate investigations on its own initiative or upon a complaint into historical land injustices and recommend appropriate redress.

For the land sector, far reaching legal and institutional reforms are envisaged in Chapter 5 of the constitution. The Chapter on Land and Environment also lays out broad principles through which land and the environment shall be managed.
