This publication offers a fresh look at the theory and practice of modern water rights, from a comparative law angle. It sheds light on a number of key features of such rights, and contrasts these to traditional forms and kinds of water rights. It teases out and discusses the relevant problematique, including in particular that elicited the sale and leasing of water rights. Finally, a stock-taking and assessment of modern water rights systems impacts are volunteered. This publication complements two earlier issues featured in the FAO Legislative Studies series, i.e.

This Regional Law regulates land relations within the framework of plenary powers transferred to the regional executive bodies by the federal legislation. Regional Government shall perform the following plenary powers: (a) decision-making related to expropriation, including bailout, in cases envisaged by acting legislation; (b) land reclamation; (c) modalities of calculation of land lease and land rent payment for public land pertaining to regional ownership; (d) validation of cadastre land evaluation; and (e) application of land use restrictions.

This brief explores the reform of land tenure institutions which re-emerged in the 1990s, and asks if these reforms are any more gender sensitive than those of the past?The paper highlights that a focus of the recent reforms has been on land titling, designed to promote security of tenure and stimulate land markets. The reforms have often been driven by domestic and external neoliberal coalitions, with funding from global and regional organisations which have argued that private property rights are essential for a dynamic agricultural sector.

The necessary preconditions for the development of agricultural land markets have been met and we are beginning to witness transactions that involve individual landowners, and not only the state.

Scientific research and conservation of the objects of cultural heritage shall be carried out by state cultural institutions and by licensed natural and legal persons. Classification of objects as cultural heritage shall be performed by the Regional Council of People’s Deputies within a year from the date of submittal of application for classification of objects as cultural heritage.
