Land rights are ascendant across the development sector. Movements addressing women’s empowerment, poverty, social justice, food security and climate change are all increasingly turning to land rights to strengthen their cause. In 2022, renowned philanthropist MacKenzie Scott joined these efforts by making an unprecedented $20 million investment in our work. Ms. Scott’s generous gift represents a profound endorsement of the power of land rights to improve the lives of women, men, and communities around the world.

    África, México, Indonesia

Sustainable land governance requires that all members of a community, both women and men, have equal rights and say in decisions that affect their collectively-held lands. Evidence shows that women can benefit from having individualised land rights formalized in their names. However, similar evidence is not available for formalization of land rights that are based on collective tenure. Studies have estimated that as much as 65 percent of the world’s land is held under customary, collective-tenure systems. Improving tenure security for land held collectively has been shown to improve resource management and to support self-determination of indigenous groups.

Why does this matter from a policy perspective? As part of a larger multicountry study on property rights to land and trees, this study focuses on the evolution from customary land tenure with communal ownership toward individualized rights, and how this shift affects women and men differently. This study’s key contribution is its multilevel econometric analysis of efficiency and equity issues.

This publication provides practical and evidence-based guidance on how to improve women’s access to land as an essential element to achieve social and economic development and enjoyment of human rights, peace and stability in the specific context of the Muslim world. The challenges faced by women living in Muslim contexts do not substantially differ from those faced by women in other parts of the world: socially prescribed gender roles, unequal power dynamics, discriminatory family practices, unequal access to justice are the most common.
