This Decree-Law amends and re-publishes Decree-Law No. 37/2014 of 22 July on the special legal regime for the implementation of land cadastre in Sal, Boa Vista, Sao Vicente and Maio islands.
This Act makes provision for the recognition, protection and registration of community land rights and also provides for conversion of community land, special rights and entitlements with respect to community land, environment and natural resources management of community land and settlement of disputes relating to community land.
This Act makes provision with respect to the procedure of escheat of property, i.e. the appropriation of any casual revenues arising within the Colonies or Foreign Possessions of the Crown (other than Droits of the Crown and Droits of the Admiralty) for or towards any public purposes within the Colonies or Possessions in which the same respectively may have arisen, including the revenue to arise from the estates and effects of persons who have died intestate and without heirs or next of kin.
The overall aim of the National Land Policy is to promote and ensure a secure land tenure system, to encourage the optimal use of land resources, and to facilitate broad-based social and economic development without upsetting or endangering the ecological balance of the environment. The specific objectives of this National Land Policy are to: promote an equitable distribution of and access to land by all citizens; ensure that existing rights in land especially customary rights of smallholders (i.e.

The aim of the Act is to provide a uniform intestate succession Law applying throughout the country; to make adequate financial and other provisions for the surviving spouse, children, dependants and other relatives of an intestate; to provide for the administration of the estates of persons dying not having made a will; and to provide for matters connected with or incidental to the foregoing.
This Proclamation of the Benishangul Gumz Regional State shall apply to any rural land found in the region. It mainly is concerned with land rights land use and administration of rural lands. Land is declared the common property of the state and people and it shall not be subjected to sale or other means of exchange. Any peasant who legally resides in the region shall have the right to hold land irrespective of gender or any other discrimination. Land administration shall be implemented through community participation. Rural land shall not be expropriated unless to use for public services.
