Land adjudication constitute a series of sequential steps that if followed carefully and correctly, can lead to a sufficient determination of the varied interests in land including whether, and where they overlap, complement, conflict or compete with each other. This is a preliminary study aiming to find out how the adjudication process as it is conducted in the context of a fit-for-purpose land administration (FFPLA). A framework of components for adjudication in the FFPLA context is first developed.

Vol 2, No 3: September 2019
Publicación revisada por paresSeptiembre, 2019República CentroafricanaScaling up promotion of land rights and improved access to land for the poor, women and other vulnerable groups has been at the core of the global land community’s agenda. Transforming a pluralistic tenure system into unified statutory rights has been a major objective of the development of property law in many developing countries. Many law and development scholars have assumed that unified land rights are a pre-condition to development and that a pluralistic tenure land system is a major source of uncertainty and insecurity. This article challenges this commonly held assumption by way of a case study of Indonesia's effort to unify the laws governing land.

Volume 8 Issue 11
Publicación revisada por paresNoviembre, 2019GlobalThe use of land consolidation on customary lands has been limited, though land fragmentation persists. Land fragmentation on customary lands has two main causes—the nature of the customary land tenure system, and the somewhat linked agricultural system. Since attempts to increase food productivity on customary lands have involved fertilisation and mechanisation on the small and scattered farmlands, these approaches have fallen short of increasing food productivity.

Publicación revisada por paresEnero, 2019GlobalIn economics, land has been traditionally assumed to be a fixed production factor, both in terms of quantity supplied and mobility, as opposed to capital and labor, which are usually considered to be mobile factors, at least to some extent. Opportunities and Challenges for Communities
Artículos de revistas y librosPublicación revisada por paresEnero, 2018KenyaKenya is the most recent African state to acknowledge customary tenure as producing lawful property rights, not merely rights of occupation and use on government or public lands. This paper researches this new legal environment. This promises land security for 6 to 10 million Kenyans, most of who are members of pastoral or other poorer rural communities. Analysis is prefaced with substantial background on legal trends continentally, but the focus is on Kenya’s Community Land Act, 2016, as the framework through which customary holdings are to be identified and registered.
