This paper considers possible answers to these difficult questions by focusing on two issues: the evolution of legal norms in response to both endogenous and exogenous changes, and the role that African customary law and indigenous dispute resolution has played in promoting coordination and cooperation among group members, thereby reducing violent conflict. This paper explores legislative actions taken by the Nigerian government that impede the continued evolution of these relatively elastic customary legal norms.

This webinar presented a basic understanding of how Prindex works. The Prindex team presented results of data collected from 15 countries. It focused on pathways for using Prindex to propel policy conversations and movement-building for policy reform with the help of panellists from some of the countries where data was collected.

Key findings: Customary tenure remains strong with only 1.2% of plots held under statutory tenure. Over 86% of women reported they have access to land under customary tenure and c.63% of women reported they “own” land under customary tenure. Tenure security is not dependent on formal documentation as proof of ownership. Men play a dominant role in land management. General knowledge of statutory and customary land law and management systems is poor. c.50% of the population have experienced land conflicts, 72% are within household, family or clan.

A second report for the World Bank’s Northern Uganda Recovery and Development Program – RDP. The objective is to inform policy processes on post-conflict land policy and administration on likely types of land conflicts and claims, their resolution, gaps in current land policy, resources needed. Survey suggests that Teso’s IDP displacement patterns are unique. Customary tenure has been transformed, with household heads now owners, not trustees, of rights in land, so clans are merely informed of sales. Common property resources are at greatest risk.

Customary land law is based on three main principles. First, everyone is entitled to land, and no-one can ever be denied land rights. A second principle is that all inherited land is family land, never individual property.

There are approximately 1.1 to 1.4 million people in the Acholi sub-region at the time of writing3 ; 295,000 internally-displaced persons (IDPs) remain displaced either in IDP camps or transit sites. Approximately 800,000 Acholis have already left the camps and spontaneously returned home over the last three years.
