Globally, about 2 billion people claim ownership of their homes and lands through a customary tenure system. Customary tenure has long been insecure and is under growing pressure in many places. But it is also increasingly recognized through a variety of mechanisms, formal and informal. RECOFTC released a new report on the recognition of customary tenure of communities living in forested landscapes in Cambodia, Lao People’s Democratic Republic, Myanmar and Viet Nam. It also includes a case study from Thailand.
The articles in this Bulletin are written by the following organizations and individuals: National Coordinator for the Defense of the Mangrove Ecosystem (C-CONDEM), Ecuador; Yayasan Pusaka Bentala Rakya (Bentala Raya Heritage Foundation), Indonesia; Venezuelan Observatory of Political Ecology and members of the WRM international secretariat in close collaboration with several allies who are part of grassroots groups in different countries.
Post-war societies not only have to deal with continuing unpeaceful relations but also land-related conflict legacies, farmland and forest degradation, heavily exploited natural resources, land mines, a destroyed infrastructure, as well as returning refugees and ex-combatants. In the aftermath of war, access to and control of land often remains a sensitive issue which may precipitate tensions and lead to a renewed destabilization of volatile post-conflict situations.
This Law prescribes for the land ownership, powers and responsibilities of the State in representing the entire-people ownership of land and uniformly managing land, the land management and use regimes, and the rights and obligations of land users over the land in the territory of Vietnam. This Decree, consisting of 19 articles divided into six Parts, defines principles, rules, and measures to mitigate adverse social impacts and to compensate damages that result from involuntary acquisition or repossession of land and fixed or movable assets, including change in land use, restriction of access to community or natural resources affecting community livelihood and income sources.
The Voluntary Guidelines on Responsible Governance of Tenure of Land, Fisheries and Forests in the Context of National Food Security (VGGT), was developed under the Committee on World Food Security as a result of collaboration among different groups of stakeholders – governments, civil society, private sector, academia. The VGGT is intended to provide a framework for responsible tenure governance that supports food security, poverty alleviation, sustainable resource use and environmental protection.

In Timor-Leste, customary institutions contribute to sustainable and equitable rural development and the establishment of improved access to and management of land, water and other natural resources. Drawing on multi-sited empirical research, we argue that the recognition and valorization of custom and common property management is a prerequisite for sustainable and equitable land tenure reform in Timor-Leste.
In the Mekong region, conflicts between local communities and large scale land concessions are widespread. They are often difficult to solve. In Cambodia, an innovative approach to conflict resolution was tested in a case involving a private company, Hoang Anh Gia Lai (HAGL), and several indigenous communities who lost some of their customary lands and forests when the company obtained a concession to grow rubber in the Province of Ratanakiri. The approach was developed by CSOs Equitable Cambodia (EC) and Inclusive Development International (IDI) with the support of QDF funding from MRLG.
