Le foncier coutumier du Tchad est appréhendé par les chercheurs comme une réalité statique et n’est pas défini de manière cohérente par le législateur. Ses fondements à savoir la sacralité, le caractère collectif et inaliénable qui ressortent dans les différents travaux, sont restés les mêmes à travers le temps. Partant de ce constat, cet article a pour objet d’analyser les mutations du foncier traditionnel de la période coloniale à nos jours.

Hence, the need to identify unambiguously parties involved in land transactions so that the root of title can be traced to ensure tenure security. This paper explores innovative ways of filling the gap with biometric data to secure land transactions.

Although the Orang Asli are the original, indigenous peoples of Peninsular Malaysia, they have been largely excluded from the country’s economic growth of recent decades. Rather than protect this marginalized community, state officials and private agencies regularly exploit the Orang Asli and their ancestral lands. Given that many of the Orang Asli’s prevailing challenges stem from their lack of customary land ownership, systemic change must come from the legislative level.
