This issue of Land Reform, Land Settlement and Cooperatives contains an interesting and wide-ranging set of contributions providing insights into land related issues ranging from Italy to the Central Andes, and from the historical development of sustainable tenure practices to aspects of agriculture sector planning. The eight articles featured open with that of Lavigne Delville, which addresses issues relating to insecurity of tenure in West Africa, and identifies what the paths of change currently appear to be.

The figures of public resources estimated to have been channeled into private pockets are so high one hopes, obviously against hope, that they would turn out to be typographical errors. A majority of the Kenyan population live in rural areas accessing land and natural resources through customary systems and institutions that operate largely outside the mainstream legal framework of land administration. Although there are clear provisions in the Constitution and the Trust Land Act on management of trust land there appears to be an unwritten policy on the part of government that sees community land as land that is not owned but rather is available for County Councils and government to appropriate through the setting apart procedure

Institutional framework for land administration and management being a whole set of services that make the land tenure system within Kenya socially, ecologically and economically relevant and operational has generally failed to operationalise the general functional components of land administration i.e. juridical, regulatory, fiscal, cadastral and adjudicative, efficiently. This is because land administration structures and infrastructures are perceived as factors external to the land tenure system itself.

The Civil Society commends the Ministry of Lands for spearheading the important process of developing the Draft National Policy, and affirms that land is central to the livelihoods of most Kenyans and as such its access, use, ownership, administration and distribution are of key national concern. Thus, having critically examined the Draft Policy we do hereby make our position on the way forward on the salient policy proposals of the Draft National Land Policy document.

Malawi, like other countries in Africa, has a new land policy designed to clarify and formalise customary tenure. The country is poor with a high population density, highly dependent on agriculture, and the research sites are matrilineal-matrilocal, and near urban centres. But the case raises issues relevant to land tenure reform elsewhere: the role of ‘traditional authorities’ or chiefs vis-a-vis the state and ‘community’; variability in types of ‘customary’ tenure; and deepening inequality within rural populations.

A second report for the World Bank’s Northern Uganda Recovery and Development Program – RDP. The objective is to inform policy processes on post-conflict land policy and administration on likely types of land conflicts and claims, their resolution, gaps in current land policy, resources needed. Survey suggests that Teso’s IDP displacement patterns are unique. Customary tenure has been transformed, with household heads now owners, not trustees, of rights in land, so clans are merely informed of sales. Common property resources are at greatest risk.
