    L’un des problèmes cruciaux auxquels font face les peuples africains est celui de la gestion des terres fertiles. C’est le cas du peuple akposso. Dès les origines, ce peuple avait établi sa tradition dans le domaine foncier et n’était pas prêt à partager ses terres avec autrui. Mais pendant la colonisation, l’Allemagne et la France ont eu leurs propres codes fonciers. De même, en 1974, l’Etat togolais a entrepris une réforme agro pastorale. L’étude de cette évolution du droit foncier montre des différences entre le droit foncier coutumier akposso et le droit foncier moderne.

    Customary Land Recognition in Zambia

    From January 15 to February 6, 2018, the USAID’s Tenure and Global Climate Change Program and Land Portal Foundation co-facilitated a dialogue on experiences of documenting household and community-level customary rights in Zambia. The dialogue brought together the perspectives of government, traditional leaders, practitioners, civil society, and academics to consider how customary land documentation can contribute to national development goals and increased service delivery in rural and peri-urban areas.

    The Ingonyama Trust Board (the Trust) presented its Annual Report for the 2014/2015 financial year. The Trust had committed R6 000 000 for the purchase of tractors to support production on communal land and noted that substantial sums of money were paid out for the benefit of 120 Learners. Employment, HR and vacancy figures were given. The Trust highlighted some performance statistics. In this year, the Board had approved 1 100 tenure rights, falling short of the target of 1 200.

    We believe that law should in principle assist vulnerable communities in changing power relations. Law is fundamentally a ‘neutral’ set of rules that constrains power by requiring decisions and actions of those in power to comply with legal rules, rights and obligations. Unfortunately, we have seen the powerful appropriate law as a tool for only protecting and strengthening their interests.

It outlines the main provisions of Uganda’s constitutional and legal framework and the protection these provide to property rights. It briefly outlines the historical background to existing land tenure relations, describes the constitutional provisions relating to land in the 1995 Constitution and sets out the main provisions of the Land Act 1998.

    Post-conflict northern Uganda has witnessed an increase in disputes over land. This has, to a great extent, been as a result of the armed conflict and its aftermath. Beyond that, other chaotic factors embedded in various social, legal, economic, and political aspects of this society have influenced the nature, gravity, and dynamics of these disputes and the way in which Traditional Institutions and the Local Council Courts have attempted to resolve them.

    Government is frequently charged with failing to finalise key policies relating to traditional authorities, for example, local government roles and functions, and communal land tenure.     In Kenya, insecure land tenure and inequitable access to land, forest and water resources have contributed to conflict and violence, which has in turn exacerbated food insecurity. To address these interlinked problems, a new set of laws and policies on food security and land governance are currently being introduced or designed by the Government of Kenya. The new Food Security Bill explicitly recognizes the link between food security and land access, and the 2012 land laws target the corrupt system of land administration that made much of Kenya’s land grabbing possible.
