The aim of this report is to serve as a diagnostic for the land information ecosystem in Botswana and enable targeted interventions for improved information management.

Maps are instrumental in the commodification of land and its exchange in markets. The critical cartog- raphy literature emphasizes the ‘‘power of maps” to (re)define property relations through their descrip- tive and prescriptive attributes. But how do maps work to achieve these outcomes? This paper examines the notion of maps as ‘‘inscription devices” that turn land into a commodity that can be bought and sold by investors. It is based on the analysis of a land reform project in the Southern African country of Lesotho.

These Regulations amend the Regulations made under the Sectional Titles Act, 1986 with respect to various matters, with various references to the Sectional Titles Schemes Management Act, 2011. Matters concern mainly documentation and certification. Regulation 30 on management rules as contemplated in section 35 (2) (a) of the Sectional Titles Act, 1986 and regulation 39 on arbitration are repealed.

Section 3 of the Deeds Registries Act 1937 is amended so as to provide for the continued registration of any registrable transaction concerning a right originally acquired in terms of specified repealed legislation. Section 16D prescribes, despite the specified repeal, that a right originally acquired in terms of or under the repealed Act, shall be transferred in accordance with the legislation which created that right.

This Act makes provision for ownership rights in buildings which are divided in sections and in part owned in common ownership. It defines ownership and real rights in or over parts of buildings and land and provides for registration of title to ownership or other real rights in or over such parts. A developer who intends to establish a development scheme must follow procedures as set out in this Act.

This Act makes provision for the registration of deeds relating to immovable property and the appointment of the Registrar of Deeds. It also provides rules for the alienation of land by the State, the manner of transfer of land in general and concerns rights in immovable property and related to leases. If the State alienates State land not previously registered in the name of any other person, then the State may transfer the ownership in the land to the transferee by means of a deed of grant issued in terms of proper authority.

The objects of this Act are: (a) to create alternative forms of land title that are simpler and cheaper to administer than existing forms of land title; (b) to provide security of title for persons who live in informal settlements or who are provided with low income housing; (c) to empower the persons concerned economically by means of these rights. The Act empowers a municipality, town or village council or a regional council (for settlement areas) to establish a starter title or land hold title scheme.
