Compared to households without land ownership or right to land (squatters), results show that land certificate ownership increases by 0.238 the likelihood of investing in agricultural equipment, whereas customary law ownership increases this likelihood by 0.374. The study suggests that public authorities recognise customary rights and reinforce legal land institutions.

Many law and development scholars have assumed that unified land rights are a pre-condition to development and that a pluralistic tenure land system is a major source of uncertainty and insecurity. This article challenges this commonly held assumption by way of a case study of Indonesia's effort to unify the laws governing land.

Obviously, the Islamic law of inheritance is a major contribution to the legal system of the world, compared to the customary laws in the pre‐Islamic Arab society that denied any proprietary right by way of inheritance to female relatives including daughters.

It further demonstrates the common views that there is a collision between the Orang Asli notion of land ownership and that of the state. In particular the discussion highlights the interpretation of customary tenure under section 4 (2) (a) of the National Land Code, 1965 and it significance with the Orang Asli customary land.

Publicación revisada por paresNoviembre, 2017IndonesiaWe examine the emergence of land markets and their effects on forest land appropriation by farm households in Jambi Province, Sumatra, using micro-level data covering land use and land transactions for a period of more than 20 years (1992–2015). Based on a theoretical model of land acquisition by a heterogeneous farming population, different hypotheses are developed and empirically tested. Farm households involved in forest land appropriation differ from those involved in land market purchases in terms of migration status and other socioeconomic characteristics.

This paper researches this new legal environment. This promises land security for 6 to 10 million Kenyans, most of who are members of pastoral or other poorer rural communities. Analysis is prefaced with substantial background on legal trends continentally, but the focus is on Kenya’s Community Land Act, 2016, as the framework through which customary holdings are to be identified and registered.
