    This paper analyzes the adoption behavior of smallholder farmers using comparable plot-level duration data for Kenya and The Philippines. We find that adoption behavior is strongly linked to the process of land ownership transfer. This relationship is found both for data from Kenya and The Philippines and is robust to the inclusion of observed and unobserved village, household, plot, and time factors.

    A community’s choice to give, or withhold, their free, prior and informed consent (FPIC) to a project or activity planned to take place on their land is a recognized right of Indigenous peoples under international law. It is also a best practice principle that applies to all communities affected by projects or activities on the land, water and forests that they rely on.

    This Act provides rules for the prospecting for and mining of minerals specified in the First Schedule to this Act. Save to the extent provided for in this Act, it shall not apply to matters relating to petroleum and hydrocarbon gases. The Cabinet Secretary responsible for mining, the Principal Secretary of the responsible ministry and any person shall be guided by the values and principles enshrined in the Constitution and in particular Articles 10, 66 (2), 201 (c) and (d), and 232 of the Constitution and the principles of leadership and integrity.

    These Rules of the National Land Commission implement provisions of the Land Registration Act in respect of the amount of compensation to be awarded for land acquired under the Act. It, among other things, sets out factors to be taken into consideration when assessing compensation. The Commission shall determine an award based on the market value of the land to be acquired.

    Evidence from the first Nairobi Cross-sectional Slum Survey (NCSS) conducted in the city by the African Population and Health Research Center (APHRC) in 2000 revealed that slum residents have the worst health outcomes of any group in Kenya (including rural residents). They have limited access to basic facilities such as water and sanitation, or opportunities for life such as education and employment, and that they endure the near absence of the public sector and law enforcement agencies in their daily lives.

It was therefore against this backdrop that land reform was identified as an essential component of Kenya’s National Dialogue and Reconciliation (KNDR) process and in particular, agenda item 4 on addressing long standing issues.
