    The objective of land payment shall be to ensure through economic methods rational use of land, to form resources for carrying out measures of land organization, improvement of land quality and land conservation, as well as of social development of the territory. Issues related to establishment, the present Law, the Land Code, shall regulate collection and use of land payment and other legislative acts. Land payment shall be compulsory for all land owners, land users, including lessees, and land proprietors, except cases stipulated by the present Law and other legislative acts.

    Land relationship in the Republic of Belarus is regulated by the Constitution, Presidential Decrees, by this Code and other Legislative Acts that implement it. Civil Code regulations are applicable to land relationship with regard to provisions established by land legislation. The document consists of XV Sections that contain 36 Chapters sub-divided into 164 articles. Section I lays down the general provisions. It contains Chapters 1-12. Section II establishes the rights and the duties of land-tenants, landlords and the owners of the plots of land.

    Part one of the Article 75 shall be amended to add the following wording: “Damages caused by expropriation or provisional land occupation, demolition of the immovable property located thereon, land restriction (encumbrance), including servitude, shall be subject to compensation to land tenants that have sustained the aforesaid damages. Valuation of damages shall be carried out by the organizations in accordance with the list and modalities established by the Council of Ministers of the Republic of Belarus.”

    This Land Code establishes that objects of land relations shall be: (a) land; (b) plots of land; (c) land rights; and (d) restrictions (encumbrances), including servitude. The following types of ownership are envisaged: (a) public property; (b) private property; (c) foreign property, including property of international organizations; (d) lifelong hereditary ownership; (e) open-ended (permanent) ownership; (f) provisional ownership; and (g) lease (sublease).

    The Parties have agreed to cooperate in the following spheres: (a) integration of early warning systems and emergency intervention systems; (b) joint participation in the international organizations and programs; (c) liability of each Party for the outbreak and consequences of disasters; (d) prevention of the outbreak of disasters; and (e) autonomous decision-making at the national level.

    This Ministerial Decree required the valuation of damages for harm caused to agricultural land and forests by the allotment of land. Natural and legal persons who were allotted plots of agricultural or forestland to increase their suitability for agricultural production and afforestation shall be pay compensation for losses to agricultural or forest production at an annual rate of four percent of the estimated total damages.

    This Ministerial Decree sets forth the procedure for carrying out tenders for land lease contracts for construction following a local decision authorizing the expropriation and allotment of land. Any legal person, individual entrepreneur or foreign legal person shall be authorized to participate in the tender. Damages resulting from the expropriation of land shall be compensated; amounts shall be based on: (a) the value of removed buildings and constructions; (b) removal cost; (c) losses due to the restriction of landowners’ and tenants’ rights; and (d) lost profits.

    The President decrees that land plots can be allotted by local self-government for public needs exclusively after expropriation thereof from former land tenant, landowner, landlord or lessee in accordance with legislation on protection and tenure of land and the provisions of this Presidential Decree. Unjustified expropriation of land plots shall be prohibited. In case of expropriation of land plot the person allotted land plot expropriated for public needs shall compensate damages and losses to the former landowners or land tenants.

    This Presidential Decree regulates certain aspects of expropriation and allocation of land to legal persons and individual entrepreneurs in Minsk and regional cities for construction in cases where there are no land use planning projects and where tender for leasehold concessions is not required by law. Applicants must: (a) specify the purpose of the lease and the location and approximate size of the plot of land; (b) demonstrate the property right to the land plot; and (c) provide banking instructions. The city council shall examine each application within ten days of its submittal.
