Land corruption risks in the green energy sector

Green energy (and/or renewable energy) requires large areas of land to operate, often more so than energy generated from fossil fuels. The acquisition of land comes with accompanying corruption risks which can lead to challenges such as land grabbing and illegal displacement of communities. To help mitigate corruption risks and their consequences, strong regulatory oversight and rigorous licensing requirements are needed, as well as transparency and community-based approaches to ownership of green energy projects.

The ongoing use of landscape-based conflict commodities — diamonds and other minerals, timber, wildlife, etc. — to finance wars continues to evolve. The success with which such commodities can be transacted to support militaries, militias and insurgencies has led belligerents to innovate with additional commodities. Housing, land and property (HLP) rights within war zones have belatedly joined the list of conflict commodities that are subject to transaction, and to such an extent as to warrant significant concern.

Large-scale land acquisitions, or land grabs, concentrate in developing countries which are also known for their corruption-friendly setting caused by a weak institutional framework. We argue that corrupt elites exploit this given institutional set-up to strike deals with international investors at the expense of the local population. Using panel data for 157 countries from 2000-2011, we provide evidence that these land deals indeed occur more often in countries with higher levels of corruption.

Large-scale land acquisitions often take place in developing countries which are also known for their corruption-friendliness caused by weak institutional frameworks. We hypothesize that corruption indeed leads to more land deals. We argue that corrupt elites exploit poor institutional setups (characterized by corruption) to strike deals with domestic and international investors at the expense of the local population. Using panel data for 156 countries from 2000-2011, we provide evidence that large-scale land deals indeed occur more often in countries with higher levels of corruption.

The rapid progress in digital information and communication technologies  (ICTs) comes with both fresh opportunities and new challenges for different sectors and actors adopting the new solutions that become available over time. Since the mid-2000s, the global land governance community has piloted a series of open data and transparency initiatives largely based on such digital innovations, aiming at increasing accountability and counteracting corruption in the land sector, both at the local and global level.

Over the past two decades, academics and development practitioners have written extensively about the harmful impact of corruption on economic development and social outcomes. From an economic perspective, corruption diverts resources away from their most productive uses, acting as a regressive tax that supports the lifestyles of the elite at everyone else’s expense. Corruption undermines the legitimacy of political systems by providing the elite with alternative ways of holding on to power, rather than through genuine democratic means.

The Corruption Perceptions Index 2019 reveals a staggering number of countries are showing little to no improvement in tackling corruption. Our analysis also suggests that reducing big money in politics and promoting inclusive political decision-making are essential to curb corruption. 180 The CPI scores 180 countries and territories by their perceived levels of public sector corruption, according to experts and business people.

A community’s choice to give, or withhold, their free, prior and informed consent (FPIC) to a project or activity planned to take place on their land is a recognized right of Indigenous peoples under international law. It is also a best practice principle that applies to all communities affected by projects or activities on the land, water and forests that they rely on.
