    Land registration and titling in Africa are often advocated as a pro-poor legal empowerment strategy. Advocates have put forth different visions of the substantive goals this is to achieve. Some see registration and titling as a way to protect smallholdersrights of access to land. Others frame land registration as part of community-protection or ethno-justice agendas. Still others see legal empowerment in the market-enhancing commodification of property rights. This paper contrasts these different visions;showing that each entails tensions and trade-offs.

    In 1984, the Land Tenure Center embarked on a project to evaluate the experiences with land registration and tenure reform in Africa. The goal was to determine is African states been able to use tenure reform and land registration to provide greater security of tenure than was available through customary tenure systems. Donor agencies focused attention on the creation of individual freehold title, emphasizing the heightened security of holding, marketability, and access to credit under such tenure.

    This paper reviews experiences and development impacts of a selected number of developing countries in Asia and Africa that have used emerging land registration approaches to rapidly secure land rights at scale. Rapid and scalable registration is essential to eliminate a major backlog of the world’s unregistered land, which stands at about 70 percent. The objective of the review, based on secondary data, is to draw lessons that can help accelerate land registration across many countries.

    Hybrid land tenure administration occurs in a number of South Africa’s state-subsidised housing projects and in the informal settlements from which the housing beneficiaries tend to be drawn. Ownership is the tenure form in most of these housing projects. Under ownership the law only recognises registered land transactions. Non-government tenure administration in Dunoon was organised by street and area committees that are part of the local South African National Civics Association (SANCO) branch, a community based organisation (CBO).

    Development practice over recent years in much of Africa prioritized formalization of land policies deemed to enhance better handling and use of land as an asset for social development. Following this trend, land reform policy in Ghana was based on a pluralistic legal system in which both the customary land tenure system and the statutory system of land ownership and control co-exist by law. The primary research question for this study was the following: What implications emerge when customary land tenure system and the statutory system of land ownership and control co-exist in law?
