Brazil has, on the one hand, strong institutions in various areas, improved social situation and, on the other, the rural land situation is still very precarious, with basic unresolved questions, such as for example, knowledge of what is public and private land, due to the absence of cadaster. The legislation moved forward in an attempt to link the cadasters of INCRA, the Internal Revenue Service, with information from the Registry of Real Estate with the enactment of Law No. 10,267 / 2001, creating the National Register of Rural Properties – CNIR.

This policy brief presents the main findings of a situational analysis and assessment of women’s and youth’s ability to access community land in Turkana County, Kenya, with a focus on their rights. The brief highlights the fact that even though policy and legal frameworks provide for equal rights and nondiscrimination in access to land, women and youth still face many land-related challenges in Turkana County. It looks at the current situation regarding community land rights and examines the bar riers that women face trying to realize these rights.

From the outset, the development of agriculture has been strongly associated with women’s endeavour. In fact, women’s contribution to agriculture goes back to the origins of farming and the domestication of animals when the first human settlements were established more than 6 000 years ago. Over the years, the division of responsibilities and labour within households and communities tended to place farming and nutrition-related tasks under women’s domain. Nowadays, in many societies women continue to be mainly responsible for family food security and nutrition.

The South African Institute of Race Relations said the Bill made it difficult for the compensation amount to be decided by a court, and the Bill did not allow the courts to examine and rule on the validity of the expropriation. The Bill tried to limit how often people could go to court about the amount of compensation. The IRR argued that 60 days was not enough time for the claimant to institute legal proceedings for the determination of the compensation, this should be extended to 180 days. Compensation should include damages for additional losses.

The Commission for Gender Equality presented on its proposed campaign called One Woman, One Hectare of Land’. The campaign aims to mainstream gender equality, for it was proposed that the State should allocate one hectare of land, for the growing of food, to the poorest rural female-run households. It was believed that this would help alleviate poverty and empower rural women. It was pointed out that where women had land, their families generally were better nourished, better educated and able to move on.

The use of three-dimensional (3D) property rights has for many years been a tool for providing secure and lasting rights for the use of land and its volume of space in complex situations involving land use in the urban society. The aim of this article is to investigate the reasons for introducing 3D property in a legal system. This is illustrated by using the Swedish system as an example. In general, without the possibility of forming 3D property units with direct ownership, other forms have to be used, such as indirect ownership or granted user rights.
