The 2012 Census of Agriculture (CA) reported 5.56 million farms/holdings1 covering 7.19 million hectares, which translated to an average area of 1.29 hectares per farm/holding. The number of farms/holdings increased from 1980 to 2012 by 62.6 percent as the average area of farms/holdings decreased from 2.84 hectares per farm/holding in 1980 to 1.29 hectare per farm/holding in 2012. The United States Institute of Peace (USIP) and the Afghanistan Land Authority sought to address this problem by testing a new model of engaging community dispute resolution in formal land registration. This report examines the lessons learned from the pilot and proposes recommendations for reform.

The Afghanistan land sector is plagued by a multitude of problems linked to weak governance, corruption and lack of capacity. There are competing claims to land, widespread conflicts, resultant landlessness and poverty. Other issues are limited availability of undisputed farmland, difficulties in accessing grazing lands and many disputes over pasture lands. These issues are exacerbated by conflicting land ownership systems, insecure land tenure and registration, weak land governance environment and uncertain and incomplete legal frameworks.

China is a socialist country and all land in China belongs to Chinese citizens as a whole. Article 10 of the 1982 Constitution upholds the Chinese land policy that reflects the traditional view of socialism - land of the country must be owned by the country (State) or its agricultural Collectives. State-owned enterprises or other organizations, which cannot own land themselves, may use land with permission from the State.

Mailo is a unique tenure system in central Uganda. It is divided into three parts: Kabaka’s Mailo, Official Mailo and Private Mailo. Private Mailo belongs to an individual, so-called landowner and it can be sold, subdivided or transmitted. Conflicts on private Mailo can occur between landowners & tenants, tenants & tenants, and landowners & landowners. A key challenge is that there is a lack of knowledge and transparency on land rights on both sides.
