    Critical Review of Selcted Forest-Related Regulatory Initiatives

    This report brings together four studies that evaluate regulatory initiatives with implications for forest-dependent communities from a rights-based perspective. These are: The Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 – India; Regulatory initiatives and selected outcomes of judicial processes in Malaysia; The Community Forest Act (2007) – Thailand; and The Indigenous People’s Rights Act (1997) – Philippines. Each study covers law making, content and implementation.

The LDN project, which was sponsored by the Republic of Korea, was carried out with the support of the UNCCD Secretariat and implemented in partnership with the Joint Research Center of the European Commission and CAP 2100 International.

    Shifting cultivation is a dominant form of farming in the eastern Himalayas, practised by a diverse group of indigenous people from the most marginalized social and economic groups. The survival of these indigenous people and the survival of their forests are inextricably linked. However, policy makers and natural resource managers perceive shifting cultivation to be wasteful, destructive to forests, and unsustainable.

    Cambodia has suffered some of the highest rates of deforestation (measured as a percentage of forest cover) of any country since the 1970s – and rates have been increasing significantly in the past decade. Even the country’s so-called protected areas have been severely impacted, despite supposedly being safeguarded under Cambodian law.

    This report highlights the importance and urgency for climate action initiatives of protecting the forests of the indigenous and tribal territories1 and the communities that look after them. Based on recent experience, it proposes a package of investments and policies for climate funders and government decision-makers to adopt, in coordination with the indigenous and tribal peoples.

    The report, “Forests, Trees and the Eradication of Poverty: Potential and Limitations,” shows that forests and trees support human well-being and are critical to end poverty. It finds that forest-poverty dynamics are affected by a range of social, economic, political, and environmental context factors, such as rural outmigration, gender norms, remittance flows, and elite capture. The report’s key messages are highlighted below. Forests and trees can help the poor face global changes such as climate change. Benefits from forests and trees to human well-being are unevenly distributed.
