    This Act provides for the establishment of the Protected Areas Commission, the Protected Areas Trust and a Trust Fund and empowers the Minister to declare national protected areas. It applies to the territorial sea, exclusive economic zone, fishery zone and continental shelf as defined in the Maritime Zones Act 2010. The Act alos provides with respect to the National Protected Areas System and allows village councils to apply to the Commission for village lands or any part thereof to be recognised as an Amerindian protected area.

    This Act makes amendments to the Forestry Act consequential to the entry into force of the Customary Land Act, 2016. It inserts in section 2 the definition of the "customary land committee" and "local government authority" and amends section 26 by inserting the words "the Minister responsible for physical planning," immediately after the words "the Minister responsible for land matters", section 30 by replacing the words "any village headman' with the words " a customary land committee" and section 32 by replacing "District Councils" with "local government authorities".

    This Act provides for the establishment and management of the Nitmiluk (Katherine Gorge) National Park. The park will also ensure the right of Aboriginals, who are traditionally the owner of certain lands, to occupy and use that land. For the administration of the park, the Act establishes the Nitmiluk (Katherine Gorge) National Park Board, whose functions include to prepare plans of management for the control and management of the park and to protect and enforce the right of Aboriginals entitled by Aboriginal tradition to use and occupy the park.

The lands described in Schedule 3 that are within State forests are set apart as, or as part of, flora reserves under the Forestry Act 1916. Forest agreements may be made under Part 2 with respect to particular regions of the State. A forest agreement may only be made in respect of a region that has been the subject of a regional forest assessment carried out by or on behalf of the Resource and Conservation Assessment Council.
