This Law amends the Registered Land Law with respect to plans and procedures for subdivision of land. The Act also amends the principal Act in Part V by deleting the heading “Division 5 - Easements, Restrictive Agreements, Profits and Licences” and substituting the following heading “Division 5 - Easements, Positive and Restrictive Covenants, Profits and Licences” and by replacing section 93 on validity and enforcement of registered positive covenants and restrictive covenants.

This Act provides for the establishment and constitution of Central Planning Authority and the establishment of the Development Control Board for purposes of control on development of land and the planning of development in the Cayman Islands. The Act also concerns acquisition and disposal of land for planning purposes. The Board or the Authority, as the case may be, shall assess and grant permission for proposed development. The Act also establishes an Infrastructure Fund and contains some provisions relative to development on the foreshore.

This Act amends the Development and Planning Law (2008 Revision) in various provisions concerning, among other things: the Planning Department, applications to carry out major developments, application for planning permission, provisions relating permissions for development, the Infrastructure Fund, Regulation-making powers of the Governor and appeals against decisions of Central Planning Authority and against decisions of the Development Control Board.

This Law makes provision with respect to registration of title in land and effects of registration and provides for a wide variety of matters regarding specific title in land such as leases, charges, transfers, co-ownership and partition, trusts and transmission on death.The Law establishes a Land Register and requires the Governor to appoint a Land Registrar, the functions and powers of which are defined by this Law. The Land Register shall consist of a register of parcels adjudicated under the Land Adjudication Law and a register of each lease required by the Law to be registered.

This Act concerns the creation and administration of strata lots and phased development of such lots. The proprietor of land upon which a building is or is to be constructed may apply to the Registrar, in the manner provided by or under this Law and prescribed under the Registered Land Law (2004 Revision), for the registration of the horizontal or vertical subdivisions (strata lots) in accordance with a strata plan, which shall accompany the application.

This Law concerns the acquisition by the Governor of land for public purposes. It sets out the procedure for acquisition by agreement or compulsory acquistion and provides with respect to comepnsation to the persons who held a right in the acquired land. The Act also provides for temporary occupation and use of any waste or arable land are needed for any public purpose.
