    These Regulations, made in terms of section 45 of the Communal Land Reform Act, concern the application for and the registration of an occupational land right. An application for an occupational land right is made in the form of Form E as set out in Annexure 1 to the communal land board. An occupational land right was introduced in the principal Act by the Communal Land Reform Amendment Act, 2013 and means a right to occupy a portion of communal land for the provision of public services granted under section 36A.

    These Regulations, made in terms of section 45 of the Communal Land Reform Act, provide with respect to a wide variety of matters concerning communal land and communal land rights. Part I deals with (application for) customary land rights. It specifies the maximum size of land that may be held under customary land right and specifies particulars pertaining to allocation of customary land right.

    Various amendments concern the allocation of land and Allocation Authorities. Section 10A concerns conversion of titles in residential land in rural areas, whereas section 36A grants power to the Minister to delegate his/her powers under sections 35 or 36 to the Commissioner. Section 59A concerns the voluntary transfer by allottees or lessees of land to the State by written agreement Section 62A provides for the issue of a certificate in the case land is set aside under the Act for purposes of State.

    This Act makes provision with respect to the recognition of tribes and certain matters regarding the administration of tribes, i.e. the institution of traditional leadership by a person designated by the tribe and recognized by the Minister.The Act, among other things, sets out the procedures for the designation and recognition of traditional leaders, provides for appeal against decisions of the Minister, defines the functions of traditional leaders, defines the jurisdiction of courts in matters of administration of tribes and defines regulation-making powers of the Minister.

    The Act makes provision with respect to titles in land, the development of selected land, and the resolution of disputes regarding land and various other matters relating to land. As a corollary to the principle that land in Lesotho is vested absolutely and irrevocably in the Basotho Nation and is held by the State, no person, other than the State, shall hold any title to land except as provided for under customary law or under this Act. Where the customary law is inconsistent with this Act, this Act shall prevail (sect. 3).

    The definition of “tribal territory” is erased from section 2 and instead a definition of “tribal area” is given. Such area has the same meaning as in the Tribal Land Act. Section 71 is amended consequently. The clause of section 13 which prohibits issue of a reconnaissance permit in respect of an area on which a prospecting licence or mining lease is in existence is deleted.

    This Act modifies the customary law of the indigenous African people of South Africa concerning intestate succession regarding of an estate or part of the estate of any person who is subject to customary law who dies after the commencement of this Act and whose estate does not devolve in terms of that person’s will. Certain provisions of the of Intestate Succession Act will apply. The Act also concerns a dispute or uncertainty in consequence of nature of customary law and disposal of property held by a traditional leader who has died and held the property in an official capacity.

    This Act amends the Communal Land Reform Act so as to: insert a definition of 'community based organisation', 'lawful resident' and 'occupational land righ'; to place restrictions on the acquisition by foreigners of customary land right or right to leasehold; the power to grant occupational land in respect of communal land rights by a board; conditions applying to such grant; and recognition of existing rights to occupy communal land as occupational land rights.
