   This Law establishes legal, organizational and financial principles of regulation of social relations dealing with expropriation of land plots in private ownership for public needs. Expropriation shall be performed through buy-out and payment of compensation to the owners of expropriated land plots. Expropriation and buy-out shall be performed in accordance with the acting legislation. Buy-out price shall include inconvenience and losses of the owner of the plot of land subject to expropriation and land price shall be fixed by the local self-government.

   The Law consists of 10 Sections composed of 212 articles. Land is the main national wealth under special protection of the State. The right of ownership of land is guaranteed. Use of the right of land ownership cannot damage rights and freedom of citizens, interests of society, deterioration of ecological situation and natural qualities of land.

   The present Law shall supplement Article 110 of the Land Code of Ukraine with a new part 3. According to this new part, division or consolidation of land plots shall not terminate the validity of limitations, encumbrances established for land plots, except for the instances when such a limitation (encumbrance) applied only to a part of a land plot which, as a result of dividing the relevant land plot, has not become a part of the new land plot formed. Article 125 of the Land Code of Ukraine shall be rendered in a new wording.

   Article 33 of the Land Code (No. 2768-III of 2001) shall be amended to add the following wording: “Land plots allotted for smallholding can be transferred by citizens for tenancy by legal entities of Ukraine and used by them for agricultural commodity production, farming without changing the specific use of these land plots”. Article 93 of the Land Code (No. 2768-III of 2001) shall be amended to add the following wording: “The term of lease of agricultural land for agricultural commodity production, farming and smallholding cannot be less than 7 years”.    This Law defines the legal, organizational, economic and social principles of conducting smallholding activity. Smallholding (individual peasant farm) shall be a business activity that is carried out without the creation of a legal entity by an individual or by family members or relatives that live together in order to meet their personal needs through the production, processing and consumption of agricultural products, vending of its surpluses and the provision of services using the property of a private peasant farm, also in the field of rural green tourism.
