Opinion and analysis on business and human rights issues in Myanmar...For the last two days I have been at the Workshop on the National Land Use Policy Formulation held at the Myanmar International Convention Centre in Nay Pyi Taw. Under discussion was the 6th, and likely final, draft of the National Land Use Policy. (Available here: http://www.fdmoecaf.gov.mm/documents)

A functioning land administration sector is the foundation for economic growth. Unfortunately, effective land registry and cadastral systems with national coverage exist in only a fraction of the world’s countries. Cadasta Foundation is working to overcome this challenge by developing simple digital tools and technology to help partners efficiently document, analyze, store, and share critical land and resource rights information.

Post-war societies not only have to deal with continuing unpeaceful relations but also land-related conflict legacies, farmland and forest degradation, heavily exploited natural resources, land mines, a destroyed infrastructure, as well as returning refugees and ex-combatants. In the aftermath of war, access to and control of land often remains a sensitive issue which may precipitate tensions and lead to a renewed destabilization of volatile post-conflict situations.

The Farmland Law and the VFV Law were approved by Parliament on March 30th, 2012. There have
been a few improvements compared to previous laws such as recognition of
    non-rotational taungya as
a legitimate land-use and recognition that farmers are using VFV lands without formal recognition by
the Government. However overall the Laws lack clarity and provide
weak protection of the rights of
smallholder farmers in upland areas and do not explicitly state the equal rights
    of women to register

    Executive summary:
"In January 2016 the government adopted a National Land Use Policy, which included the recognition
of customary land management practices. While this is a welcome first step in the necessary
integration of Burma’s customary land management systems with the national-level system,
there is an urgent need for constitutional reform and devolution of land management powers
    prior to any such integration.
