    An Ordinance to further amend the Tanks Improvement Act, 1939.

    Provisions of this Ordinance amend the Principal Act by: (a) replacing the magistrate in charge with the "Upazila Nirbahi Officer" as being an office elegible to be a Collector in the sense of this Act; (b) changing the rate of interest for compensation and lease under section 8 and section 9, respectively; (c) changing the rate of fees payable to authorized persons under section 17; (d) changing the amount of penalty imposed under section 35.

    An Act to provide for the improvement of tanks in Bangladesh for purposes of irrigation.

    In order to improve the condition of reservoirs of water the Collector, as defined in section 2, may serve a notice on the person having control over a tank which has fallen into disrepair or disuse requiring such person to carry out improvements of the tank as the Collector considers necessary (sect. 3). If improvements are not carried out to the satisfaction of the Collector he may declare the tank to be a derelict tank.

    Section 6 is substituted so as to provide anew for the reconsideration of decisions of the Board: Whoever has been afflicted by an order of the Board may, within a period of sixty days after such order has been given, apply, in the manner prescribed by law, to the Board for a reconsideration of the order. The Board may, if it thinks reasonable so to do, postpone the realization of its decision in perspective of the appellant’s request until the application submitted under this section has been settled.

    An Act to provide for the establishment of a Land Appeal Board.

    As soon as possible after the commencement of this Act the Government shall by notification in the Official Gazette establish a Board called the Land Appeal Board. The Board shall consist of one Chairman and not more than two other members. The Chairman and the other members of the Board shall be appointed by the Government. The Board shall exercise the powers and perform the functions entrusted to it by the Government or by or under any law.

    This Act makes provision for the establishment of a Land Reform Board to determine the implementation of the land reform program and a just land legislation. The Board shall consist of a Chairman and not more than two other members. The Chairman and the other members of the Board shall be appointed by the Government, and the conditions of their service shall be determined by the Government.

    An Act to amend the law relating to the Transfer of Property by Act of Parties.

    The Act deals with the transfer of property from an individual to another by means of sale, mortgage (as per point a), lease, exchange (i.e exchanging the property of land with crops) or donation. In this last case, donation must be accepted by the person in the course of the donor’s lifetime. If the recipient dies before having accepted the donation, this shall be considered null.

    An Order to provide for the reduction of maximum quantity of land that may be held by a family or a body in Bangladesh and for matters ancillary thereto.

    The Order deals with the limitation of land property by terms of its size that must not exceed 100 bights if the land is owned by family or individuals. The amount of exceeding land must return to the Government. An exemption is liable to be apllied in case of land owned by religious organization, farmers’ cooperatives or if tea, rubber, cocoa or coffee are being cultivated there; or when its use is being taken in account for industrial projects, when considered beneficial to the public interest.

    This Act deals with improving the agricultural production by means of interventions on irrigation works or the restoration of the water flow in rivers turned dry and the application of a levy on the profits arising as direct consequence of those improvements.

    An Ordinance to reform the law relating to land tenure, land holding and transfer with a view to maximizing production and ensuring a better relationship between land owners and bargadars.

    The Ordinance refers to a Bangladesh custom of leasing land, called barga, and to the tenant of that lease, the bargadar, who is an individual tending the land whose property belongs to a different owner. It states that cultivating land belonging to another person and sharing the resulting production is consented only under a barga contract.

    This Ordinance rules that land that has not been cultivated for at least two years shall be reclaimed by the Collector for a period not longer than one year from the initial declaration of acquisition, who can lease it to anybody for cultivating crops (food crops as per art. 2, clause ii). If the owner of the reclaimed land wants it back, he must notify his decision to the Collector no later than three months before the one-year expiration date, including the deposit of 50 TK/acre.
