Traditionally, the land tenure system in Southern Ethiopia may be characterised by patrilineal inheritance and virilocal residence. Young girls have very little influence over when and whom to marry. Further, they have to go to a husband that their clan or family has identified for them, meaning that they after marriage move to the home of their new husband and inherit no land from their parents. Bride prices and dowries are commonly used, and girls are seen as the property of the husband and his clan. This also implies that if the husband dies, his wife is still the property of his clan.

This Proclamation of the Afar National Regional State establishes a rural land administration system that is suitable for natural resource management and protection and that incentivizes investment within the traditional clan-based communal land tenure system. This basic piece of legislation sets out principles and lays the foundations for laws relative to land tenure and administration of rural land are to be enacted by Regional Councils in respect of each Region of Ethiopia and in accordance with the present Proclamation, laws on environmental protection and land utilization policies. This Proclamation aims at improving management and utilization of land and land resources for agricultural purposes in the Southern Nations, Nationalities And Peoples' Regional State. It applies to all land that lies outside of municipal borders. The Proclamation defines the right to acquire, free of charge, rural land by peasants, pastoralists and semi-pastoralists engaged in agriculture and the equal rights of women with respect to land and provides for the protection of such rights.
