This Act concerns control of holding of interests in land in Montserrat by foreigners, i.e. persons other than a person belonging to Montserrat (as defined in section 2(2)(b) of the Immigration Act). Subject to the provisions of this Act, neither land in Montserrat nor a mortgage on land in Montserrat shall, be held by a person not belonging to Montserrat, and any land or mortgage so held shall be forfeited to Her Majesty.

This Act amends the Property Tax Act by, among other things, inserting a definition of “non-Montserratian” and renewing provisions on appeal for property tax relief to the Commissioner (also defined by this Act). A new section (21A) on the reduction or remittance of tax and a new Part (9) is inserted. Part 9 concerns regulation-making powers of the Governor. Minor amendments are made to various other sections.

This Act vests any interest in land remaining unclaimed since the coming into force of the Land Adjudication Act, and which by the provisions of section 17(1) of that Act were deemed to be Crown Land, shall, if not claimed by 31 December, 2020, in the Crown. Any person who claims any right or any interest in land which has not already been claimed by that person under the Land Adjudication Act, shall, if he or she does not claim his or her right or interest in that land within one year from the coming into force of this Act, forfeit such right and the land shall vest in the Crown.

This Act establishes the Port Authority for Montserrat and defines its functions and powers. The Act also makes provision with respect to compulsory acquisition of land by the Authority and defines certain rules applying to port operations and navigation in ports. Some provisions concern the storage of perishable goods. The Governor may with the advice of the Authority, make Regulations generally for the conveyance, loading, discharging and storage of dangerous goods within the limits of a port.

La présente loi autorise la ratification de la réglementation commune aux Etats membres du CILSS sur l’homologation des pesticides, révisée et adoptée par le Conseil des Ministres du CILSS, le 16 décembre 1999 à N’Djaména (Tchad), dont le but est de mettre en commun (dans un cadre sous-régional de coopération) les expériences et l’expertise des Etats membres pour l’évaluation et l’homologation des pesticides afin d’assurer leur utilisation rationnelle et judicieuse, ainsi que la protection de la santé humaine et de l’environnement.

This Act makes provision for the payment of compensation for withholding of property by persons acting in collusion with tenants and for the recovery of non-paid rent. The Act also makes provision for the renewal of leases without the surrender of land.

There is established a Development Control authority which shall consist of the members as specified in section 3. It shall be the duty of the Authority to institute a survey in Montserrat on matters that are to be expected to effect the development or the planning of the development. The Authority shall be responsible for the preparation of Preliminary Territorial Plan and a report on the survey. No person shall develop any land except under and in accordance with a planning permission. An application may be made for approval in principle.
