Land in Ethiopia is held by the state, who acts as a custodian for the Ethiopian people. Even though it is the state which controls land ownership, farmers and pastoralists are guaranteed a lifetime ‘holding’ right that provides rights to use the land, rent it out, donate, inherit and sharecrop it. Everything except sell and mortgage it. On paper and under existing formal laws, women have equal rights to men as far as use and control of and access to land is concerned.

Being one of the oldest civilisations in the world, Ethiopia has an agricultural tradition that is over 2,500 years old. However the land has brought into cultivation at different times in history. Generally the Northern part of the country has experienced intensive agriculture for a long time, whereas the southwestern highlands, which show relatively less soil degradation were brought into agriculture in the last couple of centuries.

About 88% of the population is concentrated in the highlands, which constitute less than half of the national territory; here the population density is 141 persons km-2. Agriculture is the main source of livelihood and national income in the country. Over 85% of the population directly depends on it and about half of the GDP is generated from the sector. However, agriculture is small-scale and subsistence oriented, and it is in a very low state of development.

Large-scale land acquisitions have increased in scale and pace due to changes in commodity markets, agricultural investment strategies, land prices, and a range of other policy and market forces. The areas most affected are the global “commons” – lands that local people traditionally use collectively — including much of the world’s forests, wetlands, and rangelands. In some cases land acquisition occurs with environmental objectives in sight – including the setting aside of land as protected areas for biodiversity conservation.

The Government of Ethiopia and more specifically, the Rural Land Administration and Use Directorate, (RLAUD) has identified land use planning as an important tool for the sustainable development of the country. Land use planning is vital for optimising the use of the land and for reconciling conflicts between different land uses. Land use planning should be carried out at different levels – from national to regional to local including community: these different levels should support and integrate with each other.

Land degradation is a major problem in almost all the countries. In most of the developing countries, population pressure and small farm sizes, land tenure insecurity, land redistribution, limited access to credits and limited education are the factors leading to unsustainable land management. In Ethiopia, among many factors, tenure insecurity is considered as a main problem for land degradation. The frequent land redistribution and the changing pattern of land ownership with the change in Government made the farmers insecure of their land resulting in not making land related investments.

This paper examines the role of customary pastoral institutions in managing conflicts. It indicates thatintra‐ethnic conflicts can be managed customarily because of shared norms attributed to the social proximity and cultural homogeneity, whereas managing inter‐ethnic conflicts goes beyond the capacity of elders' council exercising customary law. The introduction of ethnic‐based federalism and historical political relations between different ethnic groups has weakened customary institutions in managing inter‐ethnic conflict.

Argues that the institutionalization of ethnic federalism and the persistence of neo-customary tenure result in considerable ambiguity, particularly regarding the land rights of non-indigenous minorities. Highlights tensions between these three sets of land tenure institutions – state ownership, ethnic federalism and neo-customary tenure – and their implications for minority land rights.

Peri-urban areas in Ethiopia like that of other African countries are places where much of urban growth is taking place and as a result the competition for land between agriculture and nonagriculture (urban built-up property) is intense. It is there that new properties and property rights emerge and at the same time the existing traditional or customary rights may also disappear or dissolve. This study has attempted to assess and demonstrate the process of built-up property formation process in the transitional peri-urban areas of Ethiopia.

Across rural Africa, land legislation struggles to be properly implemented, and most resource users gain access to land on the basis of local land tenure systems.
