    This Act adds a new Chapter to the Liberian Code to create the Liberian Land Authority. The Authority shall be a body corporate and shall be governed by a Commission. The primary mandate of the Authority is to develop policies on a continuous basis, undertake actions and implement programs for land governance.

    This Code of Forest Harvesting Practices seeks to provide a set of guidelines to forest operators for carrying out sustainable and improved harvesting operations. It applies to all harvesting operations within Liberia’s natural forests.     This Regulation of the Forestry Development Authority (FDA) implements provisions of the Community Rights Law of 2009 with Respect to Forest Lands ("Community Rights Law"), and determines the rules, guidelines and procedures for the establishment of authorized forest communities and to access, manage, use and the benefits of forest resources within the Republic of Liberia, and participation by communities in the reforestation, rehabilitation and conservation of forest and wildlife resources in Liberia.

    This Regulation of the Forestry Development Authority (FDA), made National Forestry Reform Law of 2006 concerns sound approach to forest land use planning to maximize the benefits of forest land allocation to Liberian society as a whole. Forest land use planning must be consistent with national land use priorities in all sectors and proposed uses for forest lands must be validated locally to ensure the accuracy and legitimacy of the planning process, and the results reached.

    This Regulation of the Forestry Development Authority (FDA) establishes the responsibilities of Person harvesting or making Commercial Use of Forest Resources under a Forest Resources License ("the Operator") with respect to the rights of private land owners and provides for a right of compensation to land owners harmed as a result of any activity or process carried out pursuant to a Forest Resources License. The Operator shall take all measures necessary to prevent harm to the property of private land owners resulting from operations, without limitation.

    This Act seeks to empower communities to fully engage in sustainable management and conservation of forests of Liberia by creating a legal framework that defines and supports community rights in the management and use of forest resources. It provides the legal framework that empowers local communities located in or near forest lands to access, manage, use and benefit from forest resources on those lands for sustenance and livelihood improvements as well as for community development. The Act provides for forestry land to be classified as Community forestry land.

    The Land Rights Policy is a national sectoral policy that provides the Land Commission’s policy recommendations for land rights in Liberia, centred on four basic types of rights: public land, Government land, customary land, and private land. In addition, a Protected Area is defined as a land which may fall under the Government Land, customary land, or private land categories, but which must be conserved for the benefit of all Liberians. The Policy will form the basis of a new land rights law, and will require substantial changes to the existing legal framework.
