    The objects of this Act, consisting of 99 sections divided into six Chapters and completed by one Schedule, are: a) to provide rules about each neighbour’s responsibility for dividing fences and for trees so that neighbours are generally able to resolve issues about fences or trees without a dispute arising; and b) to facilitate the resolution of any disputes about dividing fences or trees that do arise between neighbours.

    This Act applies for an SMBI application and an SMBI request, about development that would not have required a development permit under a superseded planning scheme but requires a development permit under the Redland’s IPA planning scheme and in relation to a class 1 building on prescribed land made by or on behalf of the owner of the prescribed land within 10 years after the day the Redland’s IPA planning scheme has effect and for which the person making the request states the owner wishes this Act to apply.

    This Act provides for the construction and repair of dividing fences, i.e. a fence separating the adjoining lands of different owners, whether the adjoining lands are wholly or only partly separated thereby and whether the fence is on the line of or, in an appropriate case, on a line on the common boundary of the adjoining lands or on a line other than the line of or a line on the common boundary, or partly on any one of those lines and partly on the other or others (sect. 6).

Part 4 provides for the incorporation of Aboriginal councils and regulates their operation. Part 8 is dedicated to the Aboriginal Coordinating Council and Part 9 to the Aboriginal Industries Board.

The objectives of the Act and its application are described in Chapter 1. Chapter 2 covers land allocation, in particular allocation powers (Part 1), reservations in grant titles (Part 2) and native title (Part 3). Chapter 3 covers reserves, deeds of grant in trust and roads. Chapter 4 is dedicated to land holdings: making land available (Part 1), eligibility to hold land (Part 2), leases (Part 3) and permits (Part 4).
