    The Law is divided into 8 Chapters: General Provisions (I); Ownership and Right to the Use Land (II); General Plans for the Utilization of Land (III); Protection of Cultivated Land (IV); Land for Construction Purposes (V); Supervision and Examination (VI); Legal Responsibilities (VII); Supplementary Provisions (VIII).This Law grants the ownership of land in rural and suburban areas to the collectives. Such land must be registered and recorded by the Governments at the county level. State-owned land may be used by units or by individuals and is recorded by local People's Governments.

    These Regulations impose upon local authorities involved in free economic zones the duty: (a) to carry out assessment of the impact on the environment of activities in the zones; (b) improve the zones through land use planning; (c) specify obligations of the contracting parties in economic contracts. The local authorities may formulate local supplementary environmental standards. Article 6 requires foreign enterprises to employ environmentally friendly technology.     These measures propose to strengthen land administration, the protection of land rights, and to improve utilisation of land in Sichuan. Chapter I provides for administration of land. The local government shall restrict conversion of land for agriculture to land for construction (art. 2). Chapter 2 concerns ownership of land and land use rights. The Province shall implement a land registration system in accordance with the Law (art. 6). Article 8 concerns the use of state owned land. The Forestry Law of the PRC shall regulate ownership or use of land for forestry.

    These Regulations are formulated in order to improve the management of land in the Shenzhen Special Economic Zone, to exploit its resources and to implement rational utilisation of the land. The Special Zone shall practice a system of "compensatory usage" and "compensatory assignment" of State owned land. A land user unit or individual shall be responsible for the protection, management and rational use of land allocated for its usage (art. 2).

    The present Regulations are made so as to enhance the management of land use by the equity or non-equity joint ventures and wholly foreign-owned enterprises and to encourage foreign investment in the province. The location and limits of the site chosen by a foreign investment enterprise shall be subject to confirmation by local planning authorities.     These Regulations aim at implementing the special protection of the basic farmland and promoting the development of agricultural production and the national economy. "Basic farmland" means cultivated land which is determined in accordance with the demand of the population of agricultural products, the needs of the national economy, as well as a forecast of the use of land for construction for specified period of time, and which shall not be occupied for other uses for a long term, or within the specified protective period.
