    This Act places restrictions on the creation of settlements, trusts and future interests in relation to rights in land and other property.Subject to certain exceptions, the Act prohibits the settlement of property, the limitation of any property in trust for another or any vesting in possession of property at a future date. Exceptions concern, among other things, tenancy for life and tenancy in common. The Act also defines the effects of any dispositions made contrary to this Act.

    The aim of the Act is to provide a uniform intestate succession Law applying throughout the country; to make adequate financial and other provisions for the surviving spouse, children, dependants and other relatives of an intestate; to provide for the administration of the estates of persons dying not having made a will; and to provide for matters connected with or incidental to the foregoing.

    Macha Mission in Choma District of Southern Province, Zambia was founded by the Brethren in Christ (BIC) Church in 1906 and granted title deeds to 3,003 hectares of land by the British colonial authority of the time. Since then the Mission has built a church, a hospital (which today includes a pioneering malaria clinic), two schools, and houses for its workers. A large market has grown up near the hospital, serving local workers and hospital visitors.

    This paper presents the empirical findings of a research study undertaken in the Western Province of Zambia. The principal objective was to explore if the issuance of land ownership certificates (LOCs) improves the customary landholders’ perceptions of security of tenure. Thus, we test a null hypothesis that: ‘There are no significant differences in the perceived security of tenure between customary landholders with land ownership certificates and customary landholders without land ownership certificates’.

    Land, and in particular agricultural land, is central to livelhoods in rural Zambia. Zambia is characterised by a dual legal system of customary and statutory law and by dual land tenure, with state land and customary land. A first wave of socialist-oriented reforms took place after independence in 1964, which abolished previously existing freehold land in favour of leasehold. Subsequent changes in government policies under the influence of structural adjustment programmes and a new government in 1991 paved the way for a market-driven land reform.
