    Disputes over land are a prominent feature of many situations of protracted violent conflict in Burundi, Uganda and South Sudan. Research conducted as part of the programme ‘Grounding Land Governance’ underscores that war reshuffles access and ownership, but also critically changes the ways in which land is governed. Land issues often come to resonate with other conflicts in society, thereby affecting overall stability. This makes interventions in land governance politically sensitive.

    After conflict, governments and donors often feel a need for up-scaling and modernizing land use. There is an ambition to achieve economic recovery and contribute to food security through stimulating large-scale investment in land. Our research in Uganda, Burundi and South Sudan suggests that policymakers should be extremely careful when promoting large-scale land acquisitions, both foreign and national. Especially in the difficult transition from war to peace, large-scale appropriation of land risks becoming a threat to tenure security and the recovery of rural livelihoods.

    In post-conflict settings, securing tenure of local smallholders is considered of major importance to reduce and prevent local land disputes, to contribute to the recovery of rural livelihoods, and to improve agricultural production. Registration and other ways of formalizing land ownership are generally believed to significantly enhance local tenure security and rural development.

    This brief discusses a pilot intervention in Rwanda led by the Belgian
    NGO, RCN Justice & Démocratie, with support from the International
    Development Law Organization (IDLO) and the Belgian Government. A
    more detailed and complete discussion of the pilot is given in Lankhorst
    and Veldman (2011a). The pilot aimed to transform the customary
    resolution of disputes involving women’s land claims concerning
    inheritance or marital relations. The intervention examined whether
    and to what extent it was possible to increase the scope for acceptance

    Forceful Evictions of Pastoralists in Kilosa District, Morogoro Region, Tanzania - Carried out From 29/01/2009

    IWGIA has recently been informed by local partners in Tanzania that a government operation aimed at forcefully removing pastoralists from the Kilosa district in the Morogoro Region in southern Tanzania started on the 29.1.2009. The Tanzanian government wants to remove all pastoralists from Kilosa district and, according to some sources, the whole of Morogoro Region, and force them to other areas of Tanzania. Such areas have though, according to IWGIA local partners as yet not been specified, and the affected families do not know where to go to.

    This paper examines the evolution and the nature of the current forms of land tenure in Masindi District and the extent to which these forms impair or facilitate positive socio-economic changes. Such an examination is vital in light of the fact that there exists no convincing empirically grounded studies on the impact of the official land policies on the relationships between forms of land tenure, social structure and agricultural production.

    The protection given to the land rights of women, orphans and any other vulnerable groups in Northern and Eastern Uganda is probably as good as can be found anywhere in the world. Customary land law is based on three main principles. First, everyone is entitled to land, and no-one can ever be denied land rights. A second principle is that all inherited land is family land, never individual property.

    Land-use conflict is not a new phenomenon for pastoralists and farmers in Tanzania with murders, the killing of livestock and the loss of property as a consequence of this conflict featuring in the news for many years now. Various actors, including civil society organisations, have tried to address farmer–pastoralist conflict through mass education programmes, land-use planning, policy reforms and the development of community institutions. However, these efforts have not succeeded in the conflict. Elsewhere in sub-Saharan Africa traditional systems are not making much headway either.
