A Decree to provide for ownership, allotment, use, registration of residential land and houses by citizens of Viet Nam and leasehold by foreigners, and in relation to this the assignment of title, the issue of certificates, settlement of disputes and other matters. The State recognises and protects the lawful title to residential houses and lawful right to the use of residential land. All residential houses and land must be registered. The lawful owners are issued the certificate of residential house title and residential land use right.

This synthesis of our findings from an investigation of tenure risk in East, West, and Southern Africa, shows that a majority of tenure disputes are caused by the displacement of local peoples, indicating that companies and investors are not doing enough to understand competing claims to the land they acquire or lease. This failure in diligence is particularly noteworthy given that a majority of the disputes analyzed had materially significant impacts: indeed, a higher proportion of projects in Africa are financially impacted by tenure dispute than any other region in the world.

This Act makes provision for a wide variety of matters relating to land tenure and reform in Lesotho including the definition of rights in land, allocation of land in rural areas, grant of title in land, vesting of land in authorities, government acquisitions and acquisition and expropriation of land for public purpose, grant of long-term leases and regularization and adjudication of title in land, including resolution of disputes by specialized land courts established under this Act. All land in Lesotho is vested in the Basotho Nation and is held in trust by the King.
