    This Law, consisting of five Chapters, regulates the requirements to transfer the land ownership of any immoveable property. It specifies terms and conditions to deal with land, benefits from the land, building and things constructed or situated on that land and things installed on those buildings. It establishes land property restrictions, registration, offences and penalties.

    In the context of transition to a more open form of government, the Myanmar government has begun to liberalize land markets and, in 2012, enacted two major land-related laws. Implementing these new land laws has proven challenging, however, as it has been difficult to integrate these laws with the existing customary practices of various ethnic minorities. To address these and other issues UN-HABITAT Myanmar is assisting the Myanmar government in developing a Land Administration and Management Program (LAMP).

    ABSTRACTED FROM EXECUTIVE SUMMARY: Half a decade into the global land rush, land-intensive investment throughout Southeast Asia continues to confront social and environmental issues such as land conflict and improperly regulated forest conversion. This study uses publicly available financial and spatial data to examine the geography of land-intensive investment in Southeast Asia, and to identify the limits imposed by problems with data availability.

    Part of a 3 year collaboration among the national human rights institutions of the region. Each of 8 national studies aims to pull together in a simple form, updated information about large-scale land acquisitions in the region, with the aim of identifying trends, common threats, divergences and possible solutions. As well as summarising trends in investment, trade, crop development and land tenure arrangements, the studies focus on the land tenure and human rights challenges.

    Change is taking place in Myanmar. Since this ethnically and geographically diverse country elected its first civilian government in 2010, a series of rapid and dramatic reforms have taken place to allow freedom of expression, an opening of the economy and the consolidation of peace. The government has also taken the first tentative steps toward decentralization. In October 2013, Mercy Corps conducted a combined economic, governance and conflict assessment that focused on Myanmar’s southern Shan State as a microcosm of the issues present throughout the country.

    ABSTRACTED FROM THE EXECUTIVE SUMMARY: Myanmar faces an unprecedented scale of structural landlessness in rural areas, increasing displacement threats to farmers as a result of growing investment interest by both national and international firms, expanding speculation in land and real estate, and grossly inadequate housing conditions facing significant sections of both the urban and rural population. Legal and other protections afforded by the current legal framework, the new Farmland Law and other newly enacted legislation are wholly inadequate.

    Debates and critiques around land policy often focus on the neo-liberal agenda of formalising land as alienable property, most notably through land titling schemes. Sometimes these schemes are posited against alternatives such as land reform and community land holding under common property arrangements. Claims and counter- claims are made for land titling as a means to boost smallholder security in the face of involuntary or otherwise unfair alienation of land sometimes under the rubric of land grabbing.
