This Act lays down basic provisions on land tenure, both urban and rural. land can be owned only by Lithuanian citizens, or by the State (art. 3). Private ownership of land conveys certain standard rights and privileges, amounting to the free and unimpeded enjoyment and disposition of the owner's property (art. 7). Usufructury rights accrue to the leaseholders of private and State-owned land (art. 8).
This Law regulates the privatization of agricultural cooperatives and collective farms.
This Act makes provision for the taxation of ownership of private land. The annual rate of land tax shall be one and a half percent of the "cost" (not defined) of the land. In the case of forest land the value of trees shall not be included. Tax reliefs for land in protective forest belts and in natural monuments, as well as for land used for purposes of nature protection, shall be established by the Government of the Republic of Lithuania in coordination with the Department of Environmental Protection.
Land shall be divided according to its use into land used for agricultural purposes and non-agricultural land. Land owners and land users (natural and legal persons) using land on the territory of the Republic of Lithuania, which has been allotted to them by State bodies or which they possess by right of ownership, shall be liable to land taxation.
The objective of this Law is to increase the responsibility of users of natural resources (not defined) for the effective and economical utilization of the national resources which are at their disposal, and to compensate the amount spent by the State on the investigation of natural resources and on the measures implemented for the preservation of the amount and quality thereof. The Department of Environmental Protection of the Republic of Lithuania shall control the validity of tax returns.
This Law establishes the modalities of: (a) setting up, keeping and liquidation of the state registers (cadastre); (b) setting up the system of the state registers and the basic principles of interaction thereof; and (c) the rights and the duties of the leading institutions as regards keeping the state registers. The object of recording in the state registers shall be inter alia territory (land) and natural resources. One on the main registers shall be the register of immovable property.
The scope of this Law shall be to ensure the rational management of agricultural land, development of land market and land consolidation. This Act shall not be applicable to purchase of land in the gardening associations. The following categories of land managers shall have the state support in the form of instalment selling of the public land for the period of 15 years: (a) natural persons registered as farmers; and (b) legal persons manufacturing agricultural commodities annual sale proceeds of which exceeds 50 percent of annual income thereof.
This Law regulates purchase of land by the foreign legal and natural persons, and also by foreign institutions and organizations that have no status of legal person but have legal capacity. It also establishes terms, conditions and restrictions on the purchase of land by foreigners. The Act consists of four Chapters divided into 17 Articles: (1) general provisions; (2) right of foreigners to purchase land, internal water and forest; (3) temporary provisions regarding the right of foreigners to purchase non-agricultural land; and (4) final provisions.
This Law regulates land registration and restriction of the right of ownership. In the Register of immovable property shall be recorded plots of land that have been attributed cadastre number (Art. 9). The following rights shall be recorded in the Register: (a) ownership; (b) servitude; (c) usufruct; (d) mortgage; and (e) long-term rent (Art. 11).
In the paragraph 3 of the Article 20 the wording “agricultural land” shall be excluded and it shall acquire a new wording: “3. Land lease contract can be cancelled ahead of schedule in case substitution of lessor of public land, lessor of private land if the request of cancellation of land lease contract is related to the provisions of the Law on land reform or of the Law on restoration of the right of ownership to immovable property. In such case land lease contract shall be cancelled in accordance with the provisions of the paragraph 2 of this article.”
