This brief explores the reform of land tenure institutions which re-emerged in the 1990s, and asks if these reforms are any more gender sensitive than those of the past?The paper highlights that a focus of the recent reforms has been on land titling, designed to promote security of tenure and stimulate land markets. The reforms have often been driven by domestic and external neoliberal coalitions, with funding from global and regional organisations which have argued that private property rights are essential for a dynamic agricultural sector.

Land reform in Southern Africa is currently at an impasse. This paper analyses the constraints to sustainable land reform and identifies ways and means of moving things forward. In addition, appendices to the document include country by country reviews of the status of land reform in each country, and a matrix providing an overview of current land issues in the region.The document finds that whilst some progress has been achieved with tenure reform in Botswana, Malawi and Mozambique, many challenges remain across the region, particularly for Zimbabwe, South Africa and Namibia.

The paper finds that while land policy and registration procedures aim to guarantee women’s access to land, practice on the ground suggests more needs to be done to support women’s rights in the implementation process.Land registration, initiated in 2003, stipulates that both spouses should be named on the certificate.

This report recounts the experiences of 130 women from various regions, ethnic groups, religions, and social classes in Kenya who have had their property rights flouted because they are women.The report presents evidence that women are excluded from inheriting, evicted from their lands and homes by in-laws, stripped of their possessions, and forced to engage in risky sexual practices in order to keep their property. When they divorce or separate from their husbands, they are often expelled from their homes with only their clothing.

The study was conducted to determine whether the gender difference in wealth and land allocation between male and female farmers in male-headed households is manifested in soil fertility indicators. It determined chemical fertility levels (fertility indicators) in the composite topsoil samples from 5 woman-owned plots and 5 man-owned plots in Ntanzi village, Uganda, on a Rhodic Ferralsol. A similar study was conducted on 8 woman-owned and 8 man-owned plots in Buggala Island, Uganda, on a Ferralic Arenosol.
