    These Regulations, made under section 77 of the Agricultural (Commercial) Land Reform Act, establish the form application for the consent of the Minister of Lands, Resettlement and Rehabilitation in terms of section 58 of the Agricultural (Commercial) Land Reform Act, 1995 (consent to Acquire Agricultural Land or to enter into an Agreement for Occupation or Possession of Agricultural Land by Foreign National).

    These Regulations, made in terms of section 45 of the Communal Land Reform Act, concern the application for and the registration of an occupational land right. An application for an occupational land right is made in the form of Form E as set out in Annexure 1 to the communal land board. An occupational land right was introduced in the principal Act by the Communal Land Reform Amendment Act, 2013 and means a right to occupy a portion of communal land for the provision of public services granted under section 36A.

Part I deals with (application for) customary land rights.     This Act makes provision for a wide variety of matters relating to land tenure and reform in Lesotho including the definition of rights in land, allocation of land in rural areas, grant of title in land, vesting of land in authorities, government acquisitions and acquisition and expropriation of land for public purpose, grant of long-term leases and regularization and adjudication of title in land, including resolution of disputes by specialized land courts established under this Act. All land in Lesotho is vested in the Basotho Nation and is held in trust by the King.

    This Act amends the Penal Law so as to introduce measures against unauthorized possession or occupation of land and criminal conveyance of land. “Criminal conveyance” means the conveyance through sale, donation or lease of land by a person who has no title to do so. The Act defines offenses relating to criminal conveyance of land and prescribes penalties for such offences. The Act also defines affirmative defense.
