    Access to land is at the heart of rural livelihoods. In sub-Saharan Africa, the pace and scale at which land is changing hands are increasing fast. Understanding these changes in land access is crucial if the systems of land governance, the practices of companies and organisations, and the initiatives seeking to influence rural development, are to adapt and have a positive impact.

Analyses national trends in investment flows and patterns; assesses the adequacy of the legal and institutional framework regulating land and investment; and examines two examples of more inclusive investments. Findings provide ground for concern as to the preparedness of national frameworks to ensure that investment pursues sustainable development goals. Also provide insights on the potential and challenges of making more inclusive investment models work in practice.

    Cameroon’s current land law appears to have two conflicting objectives: to attract investors through large-scale land concessions while simultaneously protecting biodiversity, defending local people’s rights and promoting rural development. But the legislation governing large-scale land-based investments is outdated and sometimes incoherent. The land allocation process is investor driven and does not appropriately balance economic, social or environmental considerations.

    The ways in which people obtain land in Uganda are changing fast. Land that used to be secured through inheritance, gifts or proof of long-term occupancy is now more commonly changing hands in the market. Those with wealth and powerful connections are frequently able to override local rules and gain access to land at the expense of poorer individuals. Government-backed agribusiness investors receive large areas of land with benefits for some local farmers who are able to participate in the schemes, while other smallholders see their land access and livelihoods degraded.

    Planning for climate resilience growth is increasingly important for the natural resource dependent economy of Tanzania. Central government does not have the knowledge, reach, skills or resources needed to plan for the range of livelihoods within Tanzania; but local governments, if granted the authority and resources, could plan with communities in the flexible, timely and appropriate manner that climate variability demands.

    Mozambique has become a hot spot in the global rush for land in the last decade. Growing investments in sectors such as mining, hydrocarbons, forest plantations and industrial agriculture most often target rural land held by local communities under customary law, and conflicts between communities and investors often arise. Existing laws regulating land are poorly implemented and enforced, which is due to the power imbalances existing between the government, companies and local communities.

    The constitution and enabling legislation in Uganda, as in many other countries, empower the government to acquire land in the public interest. Under Ugandan law a person whose land is identified for a public purpose must be compensated fairly, promptly, and prior to the acquisition of the property.

This paper looks at why the authority and capacity of customary natural resource management institutions has been weakened, and how this impacts on resource governance and climate resilience. The case study included looks at a new hybrid form of customary/formal institution that is emerging as a response to the stagnation of development and increasing conflict around resource access.
