This Decree concerns adjudication and registration of rights and interest in land. It sets out the procedure of the receipt of claims for adjudication and adjudication of land. It also provides for the appointment of adjudication officers, the safeguarding of rights of absent persons and minors, and for procedures in case of objection to adjudication record.
These Regulations amend the Regulations made under the Sectional Titles Act, 1986 with respect to a wide variety of matters including: sectional mortgage bonds; forms for certificates and other documents issued or made under the Act; management rules set out in Annexure 8; and registration of documents. They also insert new provisions on: replacement of a schedule for a lost or destroyed schedule of servitudes and conditions referred to in section 11(3)(b) of the Act; and replacement of documentation referred to in section 25(2) of the Act.
Le présent arrêté détermine les droits fixes proportionnels, taxes, frais techniques et cadastraux des parcelles domaniales à usage résidentiel, commercial, industriel, mixte et agro-pastoral situées dans les circonscriptions foncières de la République Démocratique du Congo, mises ou à mettre sur le marché conformément à la procédure organisée par l'article 4 de l'Ordonnance n° 74-148 du 02 juillet 1974 portant mesures d'exécution de la Loi n° 73-021 du 20 juillet 1973, telle que modifiée et complétée à ce jour, conformément à l'annexe 1.
Le présent arrêté fixe le montant de la somme due au titre de la participation financière aux frais d’aménagement et d’équipement des terrains, issus de lotissements situés dans la zone d’aménagement concerté de Nguinth Nord-Est, conformément aux dispositions de l’article 8 du décret n° 2004-356 du 18 mars 2004.Outre le paiement des redevances domaniales, l’attribution des terrains du domaine privé de l’Etat est subordonnée au versement du montant de la participation financière aux frais d’aménagement et d’équipement.
Le présent Arrêté crée un comité technique de suivi de l’aménagement foncier, de l’équipement rural et de la création de zones d’investissements agricoles.Ce Comité a pour mission de formuler des réformes pour améliorer la sécurisation des privés en matière agricole;d’évaluer la législation foncière et les procédures d’attribution de parcelles à usage agricole; de définir des stratégies de renforcement de l’équipement social et économique en milieu rural; et de promouvoir des plans d’occupation et d’affectation des sols.
Toute demande de bail emphytéotique sur un bien foncier rural objet d'un Certificat Foncier est établie sur un formulaire au modèle conforme au modèle annexé au présent arrêté.

The Act provides for common leasehold schemes, i.e. a scheme registered under this Act for the division of a parcel of land and its buildings into units.
This Act makes provision for the recognition, protection and registration of community land rights and also provides for conversion of community land, special rights and entitlements with respect to community land, environment and natural resources management of community land and settlement of disputes relating to community land.

The Act declares the Conveyancing Act, 1911 of the United Kingdom to be applicable to Malawi. The Act shall, however, not apply to land registered in accordance with the Registered Land Act. In the application of the said Act to Malawi, references therein to “the court” shall be construed as references to the High Court of Malawi.
