The history of surveys and mapping in Tanzania has been influenced by two European cultures through its colonization; first by the German and then by the British. During the German Administration, surveys and mapping activities were carried out by the Department of Surveys and Agriculture from 1893 to 1914. When the British took over the mandate for the territory after World War I, the also used the “old” German maps until when they when they started the surveys to produce other topographic maps from 1946. Mailo tenure is the most legislated form of tenure in Uganda, having its origins in the 1900 Buganda Agreement. Reforms over the years have seen the evolution of this tenure that is essentially freehold in nature, albeit with its local characteristics arising out of an unresolved tenant question. This status quo was reinstated in the 1995 Constitution, the Land Act and its subsequent amendments. Whereas it is expected that reforms introduced by the Constitution and Land Act would suffice in stabilizing Mailo tenure, this has not happened in practice.

Over the last decade, the Government of Rwanda (GoR) has introduced several land reforms through formulation and enactment of enabling legal framework, establishment of land administration institutions and implementation of national land tenure regularization. Further, the Land Act of 2013 stipulated that all landholders must formally register their land. This paper uses District Land and Housing Tribunal (DLHT) as a case study to argue that the principle conceived in the enactment of the law that established the tribunal is far from becoming a reality. It uses data of the past four years to demonstrate that DLHT is overburdened by increment of an average of 2000 pending cases every year. It further shows legal and practical challenges that hinder access to and independence of DLHT. The paper calls for drastic strategic measures to strengthen DLHT in terms of human resources and facilities.

But such land is often also used or claimed through custom by communities. What does this mean for Africa? In what ways are rural people's lives and livelihoods being transformed as a result? And who will control its land and agricultural futures?
