... Located on Myanmar’s eastern border with Thailand, Kayah State has long been isolated because of conflicts between the minority groups there and the Burmese army; as a result, little is known about its agricultural systems. As a preliminary to NGO agricultural development projects, an agrarian diagnosis of two major types of agroecosystems in the state—lowlands alluvial plains and uplands—was conducted. The objective was to identify recent agrarian changes leading to the current presence of different types of farmers in each area and understand their development potential.

Currently, Tanzania faces numerous challenges related to land ownership, especially in rural areas. The challenges include farmers-pastoralists conflicts, tenure disputes, and alienation of peasants. To address the challenges, the current policies and approaches used in the country need to be changed on the grounds that their inherent shortcomings make the policies unable to meet rampant land problems that the country has faced in recent years and continue to experience.

Malaysia has declared its vision of developed country status by the year 2020. Much has been written about its top-down development approach, its relative economic success and the social as well as environmental costs of such approach. In 2011 and 2012 the Human Rights Commission of Malaysia (SUHAKAM) set into motion a national inquiry into the status of customary rights to land in the country. As part of the inquiry, a nationwide series of consultations was held over several months in 2012, culminating in formal public hearings in Peninsular Malyasia, Sarawak and Sabah.

Studies draw attention to gender inequalities in land tenure. While some insist that gender inequalities in land tenure exists others do not. This paper discusses a study that examined gender issues in customary land ownership in the Wa Municipality. It sought to understand and find ways of bridging the gender gaps, if any. A survey covering 151 respondents comprising Chiefs, Tendamba, women and family heads was undertaken. The research revealed significant disparities between men and women regarding access to and ownership of land.

We believe that law should in principle assist vulnerable communities in changing power relations. Law is fundamentally a ‘neutral’ set of rules that constrains power by requiring decisions and actions of those in power to comply with legal rules, rights and obligations. Unfortunately, we have seen the powerful appropriate law as a tool for only protecting and strengthening their interests.
