ABSTRACT:
"Is there a ‘best practice’ model for the legal recognition of customary tenure?
If not, is it possible to identify the circumstances in which a particular model
would be most appropriate? This article considers these questions in the light
of economic theories of property rights, particularly as illustrated by the
World Bank’s 2003 land policy report. While these theories have their flaws,
the underlying concept of tenure security allows a typological framework for

Informes e investigacionesSeptiembre, 2022LaosThe case study explores the intersect between customary tenure systems and gender roles in two villages in Phongsali district in the north of Laos. The country has a diverse population of ethnic communities who depend on forests and other natural resources for their livelihoods. These communities play an important role for conserving complex landscapes. However, their traditional land tenure practices are insufficiently documented and therefore poorly understood, and even more so the gender relations in customary systems.

It outlines a number of basic principles of a methodological approach for indigenous peoples’ territorial recognition, starting from the consideration that a simple legal recognition is often not sufficient to improve living conditions for these communities. A more open reflection on the delicate theme of ‘development’ is also promoted and sought.
