    The purpose of this document is to promote a dialogue about land issues between FAO and its member countries, indigenous peoples, the Permanent Forum and other interested organizations. It outlines a number of basic principles of a methodological approach for indigenous peoples’ territorial recognition, starting from the consideration that a simple legal recognition is often not sufficient to improve living conditions for these communities. A more open reflection on the delicate theme of ‘development’ is also promoted and sought.

    This Act amends the Absentee Landowners Levy Act 1976 in Paragraph (1)(a) of section 3. That provision defines, for the purposes of the princiapal Act, an absentee, in relation to a year of levy: (a) a person, not being a company, who: (i) has been absent from Norfolk Island for more than one-half of the year of levy; and defines businesses.

    This Act provides for the imposition of an annual levy on land owned by an absentee (as defined by this Act. The levy shall be charged on the unimproved value of the land, i.e. the capital sum that might be expected to be offered for the fee simple with vacant possession of the land at a bona fide sale on such reasonable terms and conditions as a bona fide seller would require, it being assumed that no improvements had been made on or to the parcel of land. The Act allows for objections to be lodged against assessment of value.

    This Act concerns the alienation of freehold to foreigners. Sections 4 and 5 define the application sphere of the Act with respect to alienation of land to foreigners. Where any alienation to which this Act applies is entered into, the transaction shall be deemed to be entered into in contravention of this Act, unless an application for the written consent of the Head of State to the transaction is made in writing to the Minister within 3 months after the date of the transaction or within such further time as may be allowed by the Minister.

    On July 21, 2011 the then Acting Prime Minister Sam Abal announced the establishment of a Commission of Inquiry to investigate 77 land leases which were issued under the Somare government’s Special Agriculture & Business Leases (SABL). The inquiry, which was later extended by Prime Minister Peter O’Neill in October 2011 for a further five months, discovered that over 90 percent of the leases totalling over 5 million hectares were illegally obtained from traditional landowners (Zealand, 2015).

    This Act makes provision with respect to the creation of mortgages and consequences of such mortgages. The purpose of the Act is to establish a system of mortgage law in Yap State which will induce lenders to make secured commercial and residential loans, while at the same time ensuring that borrowers who execute mortgages of property in Yap State understand nature and consequences of the mortgage, and that the parties to the mortgage are protected against unfair practices.

    This Act provides for the establishment of the Federated States of Micronesia Development Bank as a body corporate, defines its functions and powers and internal organization.The Bank shall be instrumental in: mobilizing additional financial resources for development; providing of loans for projects; technical assistance; and administration of trust funds and special funds. Foreign ownership of the Bank is prohibited because of the legal capacity of the Bank to acquire, own title to, dispose of, and otherwise deal in land and waters in the Federated States of Micronesia.

    This Chapter places restrictions on the holding of land by foreigners in the State of Chuuk. It prescribes that only citizens of the Trust Territory or corporations wholly owned by citizens of the Trust Territory may hold title to land in the Trust Territory provided that the right, title, or interest of non-citizens or their heirs or devisees, in lands in the Trust Territory held by such persons prior to a specified date shall be safeguarded.

    This Chapter provides for selected matters relating to ownership of immovable property. Subject to certain exceptions, it declares that only citizens of the state of Pohnpei or corporations wholly owned by citizens of the state of Pohnpei may hold title to land in the state of Pohnpei. It refers to a provision of article 12 of the Pohnpei Constitution relative to acquisition of permanent interest in real property.

The current market driven pressures on natural resources create both challenges and opportunities for communities and governments to use and strengthen communal tenure in order to promote sustainable management of some natural resources.
