    The urgency of securing community land rights in a turbulent world

    Amid the realities of major political turbulence, there was growing recognition in 2016 that the land rights of Indigenous Peoples and local communities are key to ensuring peace and prosperity, economic development, sound investment, and climate change mitigation and adaptation. Despite equivocation by governments, a critical mass of influential investors and companies now recognize the market rationale for respecting community land rights.

    Recognition and respect for tenure rights has long been recognized as an important concern for development, conservation, and natural resource governance. This paper discusses why secure tenure rights for local communities, indigenous peoples and women are central to good natural resource governance and important for livelihoods and human rights, as recognized in multiple international conventions. The paper reviews both challenges and opportunities for securing rights in practice and highlights successful cases of tenure reform.

    Kenya is the most recent African state to acknowledge customary tenure as producing lawful property rights, not merely rights of occupation and use on government or public lands. This paper researches this new legal environment. This promises land security for 6 to 10 million Kenyans, most of who are members of pastoral or other poorer rural communities. Analysis is prefaced with substantial background on legal trends continentally, but the focus is on Kenya’s Community Land Act, 2016, as the framework through which customary holdings are to be identified and registered.

    Looking at several large-scale land deals in Mozambique, Tanzania and Zambia, this extraordinary documentary highlights the nuanced impacts of these investments. Small-scale farmers and producers, national government officials, and African policy-makers unpack the deals, showing that there are winners and losers when providing investors access to large tracts of land in Africa. For example, land deals impact differently on women and youth, and altering land regimes also impacts on access to other natural resources such as water, fish, and local indigenous vegetables.

    The Cocoa Research Institute of Ghana (CRIG), with support from the World Cocoa Foundation (WCF) the United States Agency for International Development (USAID), performed the Ghana Land Tenure Baseline Survey, the first of its kind survey of tenure rights among cocoa farmers in Ghana. CRIG surveyed almost 1,800 cocoa farmers operating 3,900 cocoa plots regarding various land tenure issues within customary sharecropping arrangements and on owner-managed land. This report describes the findings from the Survey.

    While women’s rights to land and property are protected under the Kenyan Constitution of 2010 and in various national statutes, in practice, women remain disadvantaged and discriminated. The main source of restriction is customary laws and practices, which continue to prohibit women from owning or inheriting land and other forms of property.
