ABSTRACT:
"Is there a ‘best practice’ model for the legal recognition of customary tenure?
If not, is it possible to identify the circumstances in which a particular model

Access, Use and Management Rights of Women in Customary Tenure Systems in Mai District, Phongsali Province (Lao version)
Informes e investigacionesSeptiembre, 2022LaosThe case study explores the intersect between customary tenure systems and gender roles in two villages in Phongsali district in the north of Laos. The country has a diverse population of ethnic communities who depend on forests and other natural resources for their livelihoods. These communities play an important role for conserving complex landscapes. However, their traditional land tenure practices are insufficiently documented and therefore poorly understood, and even more so the gender relations in customary systems.

Asks what is customary tenure and what do we know about tenure systems and their consequences in Northern Uganda. Examines trends in land transactions and who is selling and buying land, certificates and titles for investment, and who owns customary land. Looks at protection from land alienation, the rights of women and children, the evolution of customary tenure and continuing changes in customary law. Concludes with policy recommendations and a plea for recognition that land is increasingly a cause of conflict and impoverishment.

The history of land rights in the Lao People’s Democratic Republic (Lao PDR), hereafter referred to as Laos, is a history of customary land tenure systems which remain the most prevalent form of land tenure. As social systems, land tenure systems in Laos have been affected by and have adapted to external forces such as neighboring kingdoms, colonialization, geopolitics and war, migration, and global economic trends. Ongoing rapid changes in national socioeconomic conditions and domestic political goals continue to alter the customary tenure landscape.

Customary communal tenure is characteristic of many local shifting cultivation upland communities in S.E. Asia. These communities have strong ancestral relationships to their land, which has never been held under individual rights, but considered common property of the village. Communal tenure has been the norm and land has never been a commodity...
