The purpose of this document is to promote a dialogue about land issues between FAO and its member countries, indigenous peoples, the Permanent Forum and other interested organizations. It outlines a number of basic principles of a methodological approach for indigenous peoples’ territorial recognition, starting from the consideration that a simple legal recognition is often not sufficient to improve living conditions for these communities. A more open reflection on the delicate theme of ‘development’ is also promoted and sought.

Currently, Tanzania faces numerous challenges related to land ownership, especially in rural areas. The challenges include farmers-pastoralists conflicts, tenure disputes, and alienation of peasants. To address the challenges, the current policies and approaches used in the country need to be changed on the grounds that their inherent shortcomings make the policies unable to meet rampant land problems that the country has faced in recent years and continue to experience.

Thus, having critically examined the Draft Policy we do hereby make our position on the way forward on the salient policy proposals of the Draft National Land Policy document.

Some scholars have describe this phenomena as the “new scramble for Africa” (Moyo and Yeros, 2011). However, others have refuted such a description on the grounds that the current land deals are being negotiated by sovereign African states in the exercise of powers that they have under national laws (Odhiambo, 2011).

In Afghanistan, insecurity over land and water rights hampers investments in food production and irrigation. In rural areas, customary tenure systems, partly based on religious law, are the most relevant but suffer from weak recognition and offer little protection to rights holders. The land policy reform is on-going but remains slow. Moreover, land administration capacity is weak and improvements mostly take place in urban areas. In this context, land disputes are common and often violent.
